The company has approached B.I.F.R. as sick industrial company.Is not the union of employees necessary party in the matter as their interests are involved.Can company which is before B.I.F.R. evade payment of wages to workmen under the excuse that it is sick undertaking?

There is no requirement to make the employees union as party to the petition. Once the BIFR has accepted the case of such sick unit, all practical control over the actual affairs of the unit are taken over by BIFR so if there is paucity of funds to make the payment of the wages then BIFR has to frame any scheme.
