RISK OF LIFE

One of my neighbour had planted two numbers of coconut trees in his garden which is adjacent to my house. sometimes the braches of the tree (which is very heavy enough to take a life if fallen on one's body)falls on our house thereby making our lives threaten. on request the neighbour arranged to cut one tree which on cutting fell entirely on our house thus, damaging the house a lot. but now, he is not ready to cut the other one and the branches fall on our living area, which is a life threatening object for our family members. Please guide me as to what legal action can i take against him and under what laws to safeguard the life of my family members.

Though you can file civil case for injunction against your neighbour but given the minor thing in issue you better file a complaint under section 133 of crpc before the executive magistrate for speedy relief.

In the same context, whether we can file a case banning erection of flags, banners, etc over median causing risk and hazards to road users? Many such habits are growing menace day by day as we witness even accidents when such metal flag posts and banners encroach over busy traffic.
