(Querist) 07 July 2010 This query is : Resolved 
Sir,
Revenue officer/tehsildar passed a order of correction of girdawari ex party. no notice has ever been served upon us and no site inspection was carried out by that officer whereas he allegedly refer the report in his order. We came to know about the order after 5 months. Whether we have to file appeal or civil sui? kindly advised.

Vikas file an appeal before Collector of your area. Powers of collector in Haryana have been vested in SDO (C), District Revenue Officer and Deputy Commissioner. You shall have to file an appeal against the impugned order before SDO (C)-cum Collector First Class. As you came to know about the order belatedly so delay shall be condoned. The law has been murdered by Tehsildar openly because entry in Girdawri cannot be changed without notice to the party already shown in possession of the agricultural land. Your appeal shall get success. You shall also have to obtain stay order against your eviction from the land under the garb of changed Girdawri from the appellate authority so as to avoid disputes.
