Que.1.I would like to know from Experts the statistics in Percentage terms where in the Ex-Parte Orders went in favor of the Respondent based on Merit in any form the Courts Lower or Higher Courts?
Raj Kumar Makkad (Expert) 28 May 2010
Though no such official data is available in this regard, however, on the basis of my experience, almost nil percent of cases may be decided in favour of ex-parte respondent. Generally if the petitioner fails to prove his case then such ex-parte cases are dismissed but the question is otherwise. It says decision in favour of respondent. Dismissal of case doesn't mean decision favouring respondent. It requires cross-claim. So there is no hope of such decision in favour of respondent.
