Will

(Querist) 27 June 2014 This query is : Resolved 
My father signed his unregistered WILL for his self acqired house, before his death in the name of my brother.
We are 2 sisters residing at delhi, my mother @ father has Rs.18 lakh in postoffice monthly income deposit in joint name, since both are expired, we have taken that amount.and they nominated that after death this amount should be given to 2aughters.

Now my question can we demand our share in that house for which my father had made will, witness by 2 persons both are died and its about 3 years back my father expire and mother expired last year.

Pl. suggest us what we should do?

Now my question can we demand our share in that house for which my father had made will, witness by 2 persons both are died and its about 3 years back my father expire.

If your father has disentitled you in Will in respect of the house then you can do nothing about it.
However you can claim your share in respect of his other liquidated assets if the same is not mentioned in the Will.

You have clearly stated that your father and mother have bequeathed their liquid asset namely Rs. 18 Lakh from Post Office FD in favor of both you and your another sister by nominating your names to it, likewise he bequeathed his immovable asset to your brother. what is the disgust? Legally you cannot claim as a right to a share in his self acquired property bequeathed in favor of your brother by your father and now the Will has come into force.
