As per sec 106 of the TP act u can issue the notice. According to sec 106 of the TP Act in the absence of the contract to the contrary, a lease of immovable property for purpose other than agrl., and mfg., purposes shall be deemed to be a lease from month to month. There is, thereore, a presumption that the relationship between the landlord and tenant was tenancy from month to month.
