Encroachment

When i was young, my fater sold a land for plot purpose in S.No.459/4, , the plot owner Encroached S.No.459/3, 459/3 was joint property of our family, recently i registered the same into my name. Now, i want to clear this encroachment, what shall i do in this regard? pls advice.

you find your land's boundary and verify its measures with the help of taluk deputy surveyer. if you found that encroachment, if the property was in your possession you may file a declaration suit otherwise, the property was in the encroacher's possession, you may file a suit for recovery of possession
