Querist : Anonymous (Querist) 23 January 2011 This query is : Resolved 
Wife of accused stood as surety. Now case is acquitted. She made 5000/- as F.D. for surety and deposited in the court at the time of bail. Case is acquitted and wife died. Now can accused withdraw that amount from the court under 444 Cr.p.c. or any other provision. Husband/accused is the nominee in the F.D. record. Please advise

Yes the husband can take back the FD.
