EVIDENCE

(Querist) 03 September 2010 This query is : Resolved 
According to new amendment now evidence is to be given through affidavit. If some govt. employee lekhpal and police inspector is to be produced as witness on behalf of plaintiff and they do not get ready to sign the affidavit. What may be the remedy. They are very important witnesses.

The recent amendment in crpc has not totally dispensed with the personal evidence in chief unlike in civil case. If they are reluctant then bring then to court and examine them in chief.

Even in civil cases there is no bar in taking oral chief examination. If they want to depose orally for chief examination,you can inform the court about it and proceed with it. The court cannot and will not refuse to do it.

You can call them through summon and in that case they will appear in the court and in that case the evidence e.i. examination in chief and cross examination will be in court.
