(Querist) 17 October 2025 This query is : Resolved
I would like to enquire about forming an association for a 6-unit new apartment in Thiruverkadu, Chennai. Is it necessary to form an association? If not, will there be any issues in the future? Please suggest the correct procedure

Residents Welfare Association under the Societies Act, or a house building society under the Co-op. Housing Societies Act shall be formed and registered.

Get a RWA formed under the provisions of Societies Registration Act, 1860 registered with Registrar Societies as per rules.
You may seek professional services of a local prudent lawyer for forming and registration of RWA.

a Residents’ Welfare Association (RWA) under the Tamil Nadu Societies Registration Act, 1975.
it’s recognized, simple, and works well for small apartments.

An association can definitely be formed for a 6-unit apartment in Tamil Nadu.
But which law or framework you register under depends on what exactly you want the association to do.
You can form a Residents’ Welfare Association (RWA) and register it under the
Tamil Nadu Societies Registration Act, 1975.
Minimum 7 members (owners or occupants).
So with 6 flats, if one flat has joint owners (like husband & wife), you can easily meet this number.
You can form a Residents’ Welfare Association (RWA) under the Tamil Nadu Societies Registration Act, 1975 —
it’s recognized, simple, and works well for small apartments.

My previous post was incomplete and devoid of proper opinion, hence I have posted my opinion again.
