If there is agreement between parties to sell property , whether there is effect on filing suit for recovery instead of filing suit for specific performance

please give your valuable suggestion in this matter

If it is on agreement of sale, You will have to file Suit for specific performance with alternative prayer for refund of token amount. Drafting is very important.
