Delay in pronouncement of orders - cat

Querist : Anonymous (Querist) 11 December 2011 This query is : Resolved
I have a case in CAT (Transfer issue). The orders reserved by the single judge. But even after one month the judge had not passed the orders.

Is there any ruling which fixes the time limit for pronouncing the orders?
Devajyoti Barman (Expert) 11 December 2011
In stead of finding out any such rulings try to mention the urgency in the matter before the same bench.
That would yield better results.
Raj Kumar Makkad (Expert) 11 December 2011
I do not find any reasoning to hue and cry for the order. Generally such courts/tribunals take much time in pronouncement of orders say it may take about 2 months. It is not good to plead urgency before CAT and persuade to pronounce the order as it may lead to some adverse inference.

however,it is very unfortunate and sad that, inspite of a long legal battle, many of our courts do not deliver the orders on the reserve dates.

who can bell the cat?

I was told that there is a supreme court ruling on these delays. But, I am not able to get the case law.

I do accept the point of Mr.Makkad, if we mention the same before the bench, the order may go negatively.

Of course, it does not seem justified to keep judgment reserved for such a long time of more than one month in a petty matter like a transfer case.

However, I don't think this would have happened. May be the pronouncement would have been made any day, but your advocate would not have come to know or would not have cared to check with the CAT. So, better check the progress with the reader/peshkaar of the concerned CAT.

I have checked the court officer, they have confirmed that the orders are not ready.

In that case, you may act upon the advice of Shri Devajyoti Barman to point out some urgency.
