Mene ek civil suit dakhil kiya jisme me registered vasiyat ko laagu karane ke liye dakhil kiya jisme mere chacha ne ek unregistered vasiyat dakhil kar di jo mujhe pata hai farzi hai me mene FIR karai par police ne kuch kiya nahi FR laga di me ab 340 crpc move karna chah raha hu kya kar sakta hu or kya hoga aage kya farzi vasiyat ko forensic bhejh sakti hai court kya .please experts help me kya kar sakta hu bataye ke liye

Aap sec 340 Cr.P.C ki petition file karna chahte hai parantu aapki sec 340 Cr.P.C ki petition maintainable nahi hai kyoki jab tak Court aapke chacha dwara file ki gayi vasiyat ko fargi ( forged ) hone ke bawat apna nirnay ( order ) pass nahi kar deti hai tab tak aapki sec 340 Cr.P.C ki petition maintainable nahi hai.Aap vasiyat ki expert janch ke liye court se nivedan kar sakte hai.

Thanks for prompt reply sir . Hight court ne hume 340 move karne ke liye kaha hai . Mene FIR bhi karai par koi result nahi mila unregistered vasiyat ki koi jaanch nahi ki gai

Yes, first of all, you need to prove that the Will is forged. Please note that a Will is valid irrespective of whether it is valid or otherwise.
