Querist : Anonymous (Querist) 13 April 2010 This query is : Resolved
can a written list of questions to be asked be kept in his hand by the advocate who is cross-examining an accused? kindly tell.
Suryanarayana Tangirala (Expert) 13 April 2010
Yes he/she can.But the witness cannot look into his papers and tell unless those documents/papers are shown by the advocate who is cross-examining him(it is called confronting)
Guest (Expert) 13 April 2010
Yes it is the right way of cross examination and it is allowed by the court also.
Parveen Kr. Aggarwal (Expert) 13 April 2010
Why not?

There is no legal provision which prohibits an advocate from doing so.
Parthasarathi Loganathan (Expert) 14 April 2010
But in some cases, I have seen Judges (when coincidentally happened to be law teachers of the counsels who cross-examine) often discourage such practices and instructs the advocates to come prepared to the court before examining any witness.
Raj Kumar Makkad (Expert) 14 April 2010
There is no law in this regard. It depends upon the way of the advocate how he works. some advocates do not require any such written query and they ask the questions as per requirement of time but some ask as per their already prepared list.

I suggest you to minutely see movie-3 Idiots for this purpose.

it is more related to style of presentation of the counsel. There is no hard and fast rule to this effect.
