Cross examination

Querist : Anonymous (Querist) 24 October 2010 This query is : Resolved
Learned Members,

In order to cross examine a wife about an alleged letter communication or an email,
is it mandatory that the letter or the e-mail need to be marked in evidence?.

Is it possible to put questions related to email or letter without marking the document as an evidence. Kindly clarify.

Thanks

If the question is specific to a particular e-mail or letter then if those documents are not marked then it the evidence will be of no value.

The question is not about the documents its about the cross examining the wife with referrence to a particular document.

Should the referred document need to be marked first before cross examination.

You have to produce the documents before cross.

Cross examination is an art and it is the back-bone of any trial. You have to get the admission of facts contained in document by putting leading question to your wife.

Both can be done simultaneously.
