Consumer forum case

(Querist) 27 October 2023 This query is : Resolved
My case is at hearing of both the parties
Subsequently I led evidence through mail and wattssup chat while submitting evidence with affidavit honorable court mentioned that need to reopen the case while filling reopen petition and affidavit CPC 151 for receiving documents and mark documents

My question is that is necessary to file reopen petition while submitting additional evidence

And second question iam submitting evidence as mail conversation and wattssup chat should i submit these evidence with certificate 65B

If the evidence has been closed then for letting in additional evidence, the case has to reopened first by filing petition seeking court order to reopen the same, once it is allowed then you will be permitted to let in additional evidence

The said evidence are secondary evidence and for filing them as your side evidence you may have to adopt the procedure as prescribed under section 65B of Indian evidence act

To my knowledge, strict rules of evidence are not applicable to consumer forums.
