Construction of residential house

Hello sir,
I'm from rajasthan, jodhpur my neighbour is constructing house his first floor balcony is crossing his plot area is it legal??? His argument is that local authorities permits 3ft balcony can be constructed o/s plot area. Is it true??

Dear Harshit,

You have knocked at the wrong door, as yours is not a legal problem. You could better have approached your area's local authority to verify the correctness of your neighbour's statement. Local authorities, being autonomous bodies are fully authorised to frame their own byelaws as per the local needs and facilities.

So, if the local body has approved his property's laout plan or given him completion certificate for his property along with the balcony, that itself can be a proof that his balcony is legally valid, as per the local authority's byelaws.

Please don't mind, even otherwise also, if you are concerned with the value and beauty of your own house, when your neighbour has spent a huge amount on his property, he will take care of the value and beauty of his own house, not the value and the beauty of your property.

Please if possible let me know is there any site or portal from which we get local authority construction rules like set back rules and rules regarding construction.. What we use to say these rules in legal language as I'm not in touch with legal terminology. I would be great help for me.

I don't think anyone of us is local to your own city/town where you reside.

However, I feel, as if you are a student, not a property owner and registered only recently on 26.11.2015 just to get answer to your academic query, as you don't even know what is local authority. Your problem also does not seem to be a real one. Had that been a real problem and you the owner of the property, you could well have known whose approval process you could have got your own property constructed and completed.

The local authority under whose jurisdiction the property falls must be having its website and maintaining the rules etc.


Or visit their office and meet the authority with written complaint and submit under proper acknowledgment.


You must be aware of the authority as you must have availed the required sanctions to build your own house.
