Compliant copy in High court

Ld Counsels,

Will the high court secure a copy of criminal complaint in its records from respondent police while deciding on a anticipatory bail petition.

If the polcie refuses to give can HC be approached to get a copy of criminal compliant.

1. Will the high court secure a copy of criminal complaint in its records from respondent police while deciding on a anticipatory bail petition.
Ans: Once the criminal complaint is registered as FIR then police will produce the same before the relevant courts for the records,the nature of offence will be the determinal factor in deciding the anticipatory bail.

yes , very well the police if refuses to give the copy of the complaint, High court can be approached.



3. Will there be any records with respest to the compliance to condition in ths bail.. such as mandatory reporting at the police station for 3 weeks etc.,
Ans: If the order is conditional in nature with condition to report to the police station for 3 weeks , then the same will be pronunced in the judgment. The Police will record the same and sent to the public prosecutor for court records. In case of non-compliance, the court has all powers to cancel the said bail order.

Usually we enclose the certified copy of the complaint and FIR along with bail appliction.

I dont think the bail petition had the complaint copy attached with it. Will the court demand a copy for its records while deciding on the bail petition.

My worry is the police have tampered with the complaint and statements and have cahnged the wording to suit their case. Hence I want to get a copy from HC. I dont this my bail peition had a copy with it.

Please clarify.
