dear members,
let me know whether ambulance treated as commercial vehicle and whether it requires driving badge to the driver, cause I want to file a consumer case claiming damages to maruti van

I think ambulance is commercial vihicle but there is some tax exemssions.(In Karnataka)

I am of the same opinion. But it does not require permit as envisaged u/s 66 of the MVAct.The ambulance owner is entitled to recover charges from the user. This is essentially a commercial transaction.

Your question certainly falls within the difinition of Commercial Vehicle but if the vehicle was used exclusively for livlyhood, you can take benefit of Consumer Prtotection Act.

Dear Rajeev
You can validly file a Consumer case pertaining to Maruti van being used as Commercial vehicle. But you have to take the plea of self employment and other factor that will weigh is whether the Complainant has more than one vehicle and the average monthly income from the same. If needed more information do give a mail.

Dear Rajeev,
Your query is not clear. You wish to claim damages and file a consumer complaint, from the driver of the ambulance (maruti van), or you are a driver and wish to claim damages from the manufacturer of maruti van, which is being used by you as ambulance.

Now if you are a driver of the ambulance (maruti van), and wish to claim damages and file consumer complaint against the manufacturer of vehicle, then you are certainly the consumer as per the amended definition of the "consumer" as per the Consumer Protection Act, 1986.
