(Querist) 04 September 2011 This query is : Resolved

I AM A MEMBER OF CO-OP HOUSING SOCIETY . IN THE RECENTLY CONDUCTED MANAGING COMMITTEE ELECTION THERE WAS A TIE . EACH OF THE 4 MEMBERS GOT 12 VOTES . NOW THE QUESTION IS WHAT IS THE PROCEDURE IN CASE OF TIE IN ELECTION OF MANAGING COMMITTEE OF CO-OP HOUSING SOCIETY . THE CO -OP SOCIETY IS SITUATED IN MUMBAI . SHOULD THERE BE A RE-ELECTION OR DOES ANYONE KNOW THE PROCEDURE

check bye-laws.

check bye-laws....first is the right answer.

If your bye-laws are silent to deal with such situation then first pass a unanimous resolution in favour of either re-poll, lottery, turn by turn chairman for definite period s if all 4 have won, unanimity on one etc. etc.

Byelaws of the concerned society normally makes a mention about the election process in case there is a tie. Here in your society's case, all the four members got equal votes, so it would be better if re-election is conducted by passing a resolution by majority vote, as the managing committee cannot constitute more than the approved number of the office bearers or executive members, as per the bye-laws.
