Claim for Perjury

If anybody file petition in the Court, allegating someone else, subsequently allegations either didn't prove due to lack of evidences or evidences were not sufficient or proved to be false. Is there difference between two? and can that body can file suit for perjury in both situation?

Perjury only when the evidence is proved false , not proved will not attract perjury.

Yes. Only the false statement on oath made with knowledge that the statement is false attarcts perjury.

No , false statement in a legal proceeding is not sufficient for defamation . You must prove publication for taking action against defamation.

Lack of evidence or insufficient evidence shall not be use ful for ur case
