Charging above paid electricity bill by meter reading

(Querist) 17 September 2009 This query is : Resolved
A tenent living in South Delhi rented house, in which proper rent agreement is made, with a clause that the electricity unit charges will be Rs. 5/- per unit. The rent agreement was made by the Landlord himself. Whereas the Landlord pays by actual meter readings by electricity meter bill by the BSES Ltd, which comes to about Rs. 2.45 per unit or thereabout. The excees charging made by the Landlord for such electricity charges is unlawful because the Landlord constantly pressurised the tenant to evict the room as he is a Mother Dairy Inspector. What can the tenant resort to lawful means to remedy this unlawful excees charging by the Landlordriven

Dear Vincent,

go and file a case against your landlord for maintaining your tenancy rights. he (landlord) is only the custodian of his flat, in no way he is authorise to charge Rs.5/- per unit as electricity charges and if he has made this clause in the agreement, then your bonafide will prove before the court of law.

also file a cheating case/complain against the said landlord.riven

I am in complete disagreement with Parthaprotim because no agreement can be made beyond the scope of law. Electricity Act strictly prohibits sale of electricity by any individual hence landowner cannot sale it more than the rates prescribed by DSES so it is better to approach either elctricity company or to file consumer complaint.riven
