ancestral property case is settled between 2 brothers in cash.what amount of decree can a session court has power to pass.thanks
Quick Summary
An ancestral property dispute between two brothers has been settled through a cash agreement. The discussion clarifies that if the settlement is a compromise, the court will issue a decree based on the written terms signed by all parties. It's important to ensure the compromise memo is technically sound to avoid issues and that the settlement terms comply with the law. Consulting a lawyer is recommended for proper advice.

give facts of the case.
T. Kalaiselvan, Advocate (Expert) 16 February 2023
If it was a compromise settlement then the court will pass a decree and judgment based on the compromise terms and settlement reduced to writing and submitted before court signed by all parties to the suit.
Therefore you may prepare the compromise memo properly without any technical fault so that it need not be rectified subsequently and obtain the decree of compromise settlement.
