Can occupant sell the land?

Querist : Anonymous (Querist) 22 December 2009 This query is : Resolved 
DEAR Experts of the forum,

An occupant of land/ (as a Koweldhar ? No written document) for a period of 12 years, have (any) right to Enter in to Agreement of Sale or GPA for the land to a third party without informing/ (notice to) the Pattedhar ? This case pertaining to State of A.P.

Your quarry is not clear.
If he is illegal occupant, he is not entitle to entertain any sale agreement or GPA.If he is protected tenant, the law is different.

For a party to sell a property he shall be the absolute owner to that property and not otherwise. So in this case the occupant can not sell the property.

Actually the tenant is declared as occupant under respective law.However if you are declared as occupant of old tenure land in that case you can do,but if your land is new tenure land,you cannot transfer it.
