Can my Advocate sue for Non Payment as I do not take receipts from him ??

I always pay my advocate in cash on each date but I fear that if I would have to leave him, he may sue me for Non payments.

Where do I stand legally ?

What should be done so that he may not sue me?

Can he sue me on for Non payment the basis of some clause in the Vaklatnama ??

If the fee payable is already fixed between yourself and your lawyer,he can sue you for the balance of his fees.But you always have the protection from the Legal Practioners Fees Rules by which all the advocates are bound. If you have paid the fees payable to him as per the said rules,then your duty towards him is discharged as he cannot claim anything in excess of the said rules.

he can sue you, its better to talk to him and settle the matter....it will be more cheaper and peaceful.

The relations between the advocate and client can not be defined by any law or procedure. It is relation of trust. If only money is your problem talk frankly with him.

Remember if you have no trust how can an advocate get you justice, money is very minor matter.

Do not rush to prejudge the lawyer once you have chosen wisely and engaged him. Trust begets trust. Place a request for receipt. You will reap as you sow.

For getting N O C you have to pay what you have promised to pay.

I agree with mr.subramanian. If you want change your advocate mean, you have to pay the balance fees what he or she expecting.. Otherwise he won't give no objection to file a fresh vakalath. Usually without no objection from previous counsel, nobody file fresh vakalath on behalf of you. ..tom..
