Can i get share from the property

(Querist) 19 August 2011 This query is : Resolved 
Husband and wife are working. Both take action and purchased a plot and construct the house. Property was purchased after the marriage and was registered on husband name, does a wife has any rights ( or share) on that property? wife & husband are not in good terms now, but they aren't living together, there is no divorce, planning for divorce)
Further, the land was purchased by pleadging wife jewels, by bank loan of husband and wife and saving of LIC of husband and wife and wife is the co-applicant for the Home loan.
what is the remedy. Can wife claim half of the share of the property. If she got married after divorce

If wife is able to prove the pledge, she can file a suit for recovery of the land by way of filing a suit

Wife can not claim half any share of the property.But ,if she have any proof,wife claim money only.

If proof is indeed there there then the wife will have to file a case under Benami Transaction Act to get her due share.

This Act makes exception for the properties purchased in banam of the spouses.

In case, she is the co-applicant for the loan raised to purchase the property, she can.
