Can I apply for passport

Dear all respected people,
I have a FAKE criminal case against of me 302,307 ipc from 2012 And it's still under trail in court ,
But in the FIR have not my name it's against of Some 20 unidentified unknow peopleS,
And also have not hard proof against of me In case ,
But police did let my name in case After 20 days during them investigation.

Can I do apply for passport if yes than what all I have need to do for it ,because I have need passport .

Until you get clean chit in the police case against you you can't apply for passport even though it i is fake..
