Can a builder sell terrace in bangalore

I have been looking for 3 bedroom apartment in Bangalore. I came across a builder who is giving exclusive access to the terrace for top floor flat owners from their one of the balconies.All top floor will have their separate balconies above them and will charge 2.5 lakh extra for it. Is this legal in Bangalore??

at least in mahrashtra builder cannot sell terrace . it forms part of common area for benefit of all members . contact a local lawyer in bangalore
