What action can we take on this person

Sir,

We are having 1.20 Acres agriculture land in survey no:65 (1.11 & 80 (0.09)in EC & Pattadhar passbook. but if we see in link documents its showing 1.02 & 0.18.Now in survey number 80 (4.19 acres) remaining 4.01 acres land person created pattadhar passbook (4.19 acres) & kept for bank loan and then registered land (4.19 acres) in 2006 by managing some revenue department officials (M.R.O).
what action can we take on this person

Land is in court

I am satish,

We went for agriculture land link documents (4.9 Acres ), Register officier said this land is in court, he given all the transaction done in that survey number.
Finally he given.

Wrong affidavit

Sirs,
I have taken a home loan in the year 2002 from a nationlised bank and an education loan from the same bank in 2010. While taking the Edu.Loan Bank wanted me to execute a deed " memorandum of Deposit of Title Deed" covering the home loan amount and the education loan amount along with an affidavitin which I affirmed that I am the absolute owner of the property, the document of which is being deposited.

Now the Sub Registrar( the office at which both docs were registered) demands higher stamp duty( in the year 2016) as they treat my affidavit as Morgage. In the affidavit, the home loan amount has been mentioned wrongly( nearly ten times more by a zero addition, a typing mistake).

Please suggest me me a remeady.

Land given on contract to use

I have a agriculture land which i want to give it to other party for performing agricultural operations, the profits earned out of it will be shared equally between owner and other party. What document is required to be prepared for such situation.

Simultaneous proceedings for recovery through sec.138 nia and arbitration

Learned Experts,
One of my client is facing simultaneous proceedings with respect to recovery of dues by an NBFC which are as follows:

1. They have filed a complaint under Sec.138 of NI Act by presenting and bouncing a cheque which was given as security. More than 65% of the loan is repaid and around 35% remains to be paid. The cheque is for the total amount of the loan, and not for the actual liability. Now the case is at the stage of evidence.

2. The NBFC have initiated arbitration proceeding to recover the same outstanding amount. Thereafter, the NBFC granted time till April 2016 to clear the outstanding.

Under the circumstances, my queries are as follows:
A) Can the NBFC initiate proceedings under 2 different enactments simultaneously for the same recovery?
B) When the term of loan facility / credit facility has been extended for further period, is the arbitration proceeding valid?
C) isn't the cause of action is nullified by issuance of letter of extension of loan period??
D) Isn't there a need to initiate separate arbitration if the loan is not cleared before the extended period?

delation of one of the accused.

I filed a complaint aganist three persons in a police station and SHO issued FIR and aganist the three and later sho filed charge sheet in the court delating one of them who is the main accused and involved in the crime.now i received a notice from the court regarding the same to submit my objections on the matter..hence i request you all the experts what i have to doin this matter.kindly advice on this.thanq sirs in advance.

Regarding deed to divide the property

Hello all,

My grandfather bought a property, and after his demise the property came to my grandmother. Now, she is the owner of the property and she wants to divide the property equally between her two sons. My question here is, what is the right way of dividing the mother's property between her two sons?. Also, my grandmother has two daughters, do they have right on that property and if so, what should they do to release their rights and allowing the two brothers the whole right. Please help me in this issue. Thanks a lot.

Can any one ask for the Personal information( Service Records,pension declaration details) of a Person ,under RTI Act. 2005. Will the Officer -In- Charge will provide these details,Under the RTI Act.2005 or is there any bar?

Regarding land agreement

If a sales agreement was made before 1985 & the sales agreement was written on white paper with both the seller and the witnessner were signed on it and the full amount was paid.and the agreement was made without any time limit. in that agreement the seller mentioned "that the buyer can register the land at any time he wants".and he will be ready at any movement to register the land .

In case after 25 or 30 years if the seller refused to come to registration or trying to sell the land to another person what will happen ? Who will win the case the seller or the buyer
Note: but the land was yearly agticultered by the buyer he is the one who is cultivating the crops & he is also paying "kisthey" for that land.
