This is regarding alleged claim of 49th EMI by Axis Bank, but originally signed up for 48 months.
As guided, by the Veterans, of Lawyers Club India, I raised the issue before Axis Bank's internal ombudsman forum, and the bank replied,
"We regret to inform you that we are unable to share the original loan agreement and the payment proof of the first instalment, due to unavailability of the required documents."
Now the bank has explicitly said that they have no documents to prove the claim,
it is alarming, how is it really possible? in case of non payment or default how will the bank recover before the court of law without having the proof of documents.
It is not clear that whether they deliberately, avoiding to provide the dox for the unauthorised 49th EMI claim, or really do not have the relatable dox with the bank.
The bank only attached the amortisation statement as a proof, without any authentication, which is very well availble free at the google calculator.
From their reply, I understand it is
- Lack of transparency,
- Lack of professional diligence,
- Non-adherence to RBI guidelines, and
- Absence of ethical responsibility in maintaining records.
Now, I request with folded hands, the veterans please help me to proceed with next steps, and save from AXIS Bank.

For weeks now I have been in my partner's phone with the help of spyhackelite@ gmail com hoping to see if my partner is cheating, I monitored his phone and found a chat. I went through the whole chats and also went through deleted chats only to find out that every Saturdays and Sundays my husband always go for morning jogging and he would text this particular girl to know if she's home, he would jog to her house just to f u c k her. Land being purchased by private party with lawful process , Government claim the land has been acquired before the current owner has purchased the property with no evidences of prior land acquisitions and any legal proof from govt .
Should I file suit for declaration or It needs be managed under writ ?
If suit can we file Suit for declaration and specific relief act together in one suit ?

Also how to mention the list of documents submitted at the end of affidavit (details if should contain).
This will help in submitting my evidence affidavit in my Divorce case.

Hi, I have purchased a property in 2019 which is a second hand flat in Pune (PCMC). The total area mentioned in agreement is correct while in Index 2, area of the open terrace is not mentioned. In this case, they have miscalculated registration charges too probably (which I am not sure of). The society is planning to go for reconstruction now and conveyance deed is under progress - Index 2 of all the residents are being collected. In agreement, total terrace of 1365 sq ft is mentioned which is missing in Index 2. I have some queries now - 1. Is Index 2 considered as the only and final document for conveyance deed? 2. If Index 2, or conveyance deed does not contain terrace area, will it affect the area I will get during reconstruction? 3. If needed how can I get Index 2 corrected? 4. Is there any option to get it corrected online?

My father expired. He was single owner of flat.
We are 3 legal heirs viz. my mother, myself and my sister which have equal share of 33.33%
Can we execute release deed in the following ratio
Mother - 50% (+16.66%)
Son - 25% (i.e release 8.33% in mother name)
Daughter - 25% (i.e release 8.33% in mother name)

Sir, as stated earlier, I have a case of declaration pending with my tenant who claim to be owner of my shop on fake papers. Tenant name is Nanney.
Therein, tenant nanney , after his cross, bring a witness namely Rahul who claim that he was a witness in a agreement of year 1998. (i.e. 27 years ago).
According to witnesses and my advocate's cross examination, he was called by nanney in 1998 through his grandson amaan who is almost 5-6 years old that time and now approx 35 years old.
Now, we know that he is lying because nanney himself in his various affidavits says he is 69 years old now.
We know grandson amaan also, he is hardly 25 old now. Also we have his father's and mother's Voter Id slip who are 48 and 45 years old now. How can there son be 35 years old ?
What did we do now ?
1. Call grandson amaan in court ? Which is a lengthy process.
Or
2. Request court to cross tenant nanney again and ask him questions relating about his, his son, son's wife and grandson's age. Nanney is present on every date.
Or
3. File perjury u/s 340 against witness rahul ?
What else we can do now ?
Which is better, fast and more fruitful process ?

Dear Expert,
We have a ancestral property of father of my grandfather. My grandfather were three brothers.There are no partion executed For that property till date.my grandfather had the one third share of that Property.My father are six brother.My father has given his share to my younger uncle.which was just written on the stamp paper. no legal process to transfer the share was done. My query is that my father has right to transfer property to my uncle without my consent or Not.
