My client owned a Cloth stores... Recently he removed the labour without issuing any prior notice to him on the basis of misconduct..
The labour filed the case before the Govt. Labour Officer who summoed my client .. we had filed reply as well as the NC report lodged against the labour about his misbehaviour... but the labour officer wants to examine the records which were not properly maintained by my client...and recently the labour had filed the application under Sec. 2(f) of ID act for refer the matter to the Labou Court
(The case is of Maharashtra State)
Pls guide what I have to do ?

actully i know a lady she is working with a govt school since last 20 years as aaya (peon) she was earlier getting 250 bt now she is getting 1000 p.m as salary she have all attendence registers where she puted her attendence of 5 years and the salary recipt register , so i wanna know that there is any law by which she can get a permanent job.or any other relif cz in todays scnerio no body can survive in 1000 rs per month she hv 5 kids so pls can any body help her.and provide any way by which she can get relief and jisse school authority use hata na paye or uski salary badh jaye

I'm a HR working in a Pvt Ltd Company. I have a query regarding payment of bonus. As per our company policy, we pay bonus to employees on early basis. I wanted to know is there any provision in Payment of bonus act to pay the bonus amount on a monthly basis to the employees instead of paying it yearly basis. My wife is having a vigilance case. The case is in the court, in admission stage. She has to attend an official conference in Australia. Her paper is selected for presentation. She is not having a passport. Government has denied NOC for passport. Is there any remedy for her?

Hi,
As per my offer letter, there is two months of notice period to be served after resigning. I have generally seen there is an option to "buy out" notice period. BUT however, in my offer letter it is not mentioned there.
It is just written in case of separation from the company two months of notice period has to be served. Pls see Point No. 12 in the attached file.
I am ready to serve one month notice period and pay my company in lieu of next one month. But the company is not ready for this also.
Is there any possible way I can pay my company and get relieved after serving one month notice period.
I have heard that under "Labour and Service Law", the Hon'ble Supreme Court of India has cited that an employee can be relieved if he/she is willing to pay for the notice period. Can anyone please give any link or state under which sections this has been stated.

sir, i was appointed to one company, initial two years was training period in taht time management dismisse me,how can i get my job back, and one my friend also dismissed from the work,but he was completed tahe training period but management by extending the tarining period dismisse him/
this are all happend before one year
now in taht comapny one more partner added,thereafter management dissmissed employees eppointed by the eartwhile employer

Sir,
Ours is an ICAR institute, and engaged 33 workers as casual workers based on Hon'ble High Court of Kerala Judgment. They were working with effect from 1-4-2009. We have not started subscribing to EPF and ESI contributions because of our ignorance. Whether we have to pay both the workers and employer contributions with effect from 1-4-09 for opening the accounts. We are planning to join the EPF and ESI subscription immediately. Kindly advise.
