Out door gatherings

Dear Experts,

This is regarding a request to help me in suggesting any OutDoor HR Meeting/Gatherings happening in the city.

Am an MBA(HR) student just done with my course, and intrested in Knowing the HR practices/ policies and build my self mentally to fit for the present market.

after finding I came Across NHRD as flat form for sharing views. My question is are there any other such formus or out door gatherings being organised in our country or city.

Need information on gratuity fund on private limited companies

Hi i am working in a company and its duration is 5.6 years. This is a private limited company and it has got 45 head count working in it. So can i get my Gratuity Fund, currently i am leaving from the company and kindly let me know whether the rule is applicable for the private limited company or not. If there is a chance kindly let me know how to proceed on this.

Permission to resignation

Dear Experts,
I need views on one very important point .

An Officer of the Bank who was charge sheeted after submitting resignation which was rejected in writing by bank after inducing him to sign the enquiry papers admitting his guilt.Being not relieved as per understanding and getting orders of Compulsorily retirement ,the officer submitted review to Chairman rebutting all the charges and requesting for reinstatement.His review was considered by cmd vide note dated 18.12/98. He was asked to submit one letter which is attached as attachment stating that he may be allowed to resign in case reinstated. He did submit this letter on 19/12/98 i.e after the date of office Note.
Bank authorities though reinstated him back and he joined the services on 28/12/98 but he was relieved on the same date of joining the duties stating that your resignation has been accepted.
According to my knowledge since officer was not in service on 19/12/98 so this letter can not be treated as resignation at all .besides the wording of letter clearly speaks of that this is letter seeking permission to resign which itself can not be treated as resignation even in case he would have been in service on date. Besides by reinstating the officer his earlier resignation had in law come to end and it includes this letter of dated 19/12/98.the only resignation submitted was rejected in writing so it can not be acted upon. it is his misfortune that bank misepresentated the facts before courts and got the order in favour by getting the letter dated 19/12/98 treated as resignation which according to me is totally a wrong order obtained by playing fraud with the courts.
Please go through the attached letter and offer your expert comments that whether it can be treated as resignation at all.
It is also important to note that under RTI he has got three documents / letters from bank wherein they have stated that he was relieved by accepting his resignation dated 22.06.98.(it was rejected on 11.08.98) and in another letter stated that he was relieved by accepting offer dated 19.12.98. Offer can not be treated as resignation at all .
Your views awaited so that the relieving on letter dated 19/12/98 which was letter seeking permission to resign can be challenged as he was not firstly not in service on that date and secondly an offer /letter seeking permission can not be taken as resignation.

Place of suit

Respected expertises,

my quarry is that.
one person A. is the owner of tractor trolly, employed his tractor trolly in the construction work of a private contractor,
it is about two year spend but contractor did not pay him any payment,

what is the remedies for the A,

in which court should file the suit, ie in labor court or local Munsif court.

What is the exact proof of date of birth to b considered by govt

Sir
I am dealing with a matter wherein a scheme for Group D post appointment was to b granted to already working hamals in the Railway
While submission of application proof of date of birth was asked by the Dept my client had submitted initially school leaving and after municipal corpo date of birth certificate
Now if school leving is considered as proof of DOB then he is age bar and if Corporation's is considered he is eligible
Now my q is what the law says (Sec Act )or the Supreme or High Court Jughement if u can pls provide that what is to b considered as a legal proof for exact DOB ?

About payment and continuation

i am working as post graduate lecturer in a permenantly nongrant institution. i was selected through a selection committee consisting of university members ,subject expert and institution personnel.i have qualified NET examination.college didnot mention the nature of appointment ie contract in advertisement .it only mentioned "REQUIRED FULL TIME LECTURERS".WITH QUALIFICATION.THEY MENTIONED THAT PAYMENT WILL BE AS PER UGC NORMS.after selection collegegave me order in which it was mentioned that "you will be appointed as a lecturer for 2 years and after completion of this period conract will be terminated.during this period only i got approval from university that i am on probation for 2 years and my services may continued ie i may be regularised after 2 years.i was given a fixed salary of 8,000 rs .i have completed my probation 2 years before and from last 2 years i am serving in same institution but college has not issued me a continuation letter also they promised me orally that my salary will be increased as per society norms .other teachers are getting 25000 rs for the same work with same qualifications.i demanded continuation letter and incrased salary but no response is from the institution.what should i do now? is my service be considered as regularised automatically? can i claim salary as per ugc norm with arrears? plz do reply.

Gratuity for teachers of un-aided schools in maharashtra

Respectd Sir,
Myself was working in un-aided school since 1985 to 2008.where gratuity were paid to the teachers upto 2004 but after Apex court judgement regarding Gujarat primary teachers case our management denied gratuity eventhough it was mentioned in our Appointment Order that gratuit ill be paid according to MEPS Rules & Services Act 1981.
My question : Whether I should get Gratuity from the date of Appointment i.e.1985 or 1997 after the said Ammendment?

Notice period

Hi Everyone...
I need expertise solutoin to my problem. I am employed with an MNC, during the course of the time I got a govt job which needs me to be joined immediately. As per my company rules one has to serve 3 months notice period after resignation. I was unaware that I will be selected for the government job. Now when I told my officials the problem they want me servce notice period for sure otherwise for the payout. I cannot afford the payout however I have offered them for 1 month payout for which they are not in an agreement.
What should I do in this current situation. Please help me.
Also is there any law that states if one gets a government job all the terms between that person and the private company will get voided ? can they waive my notice period on these grounds ?
Please please help me. waiting for your response.

Regarding the date of birth.

Respected Sir,
My client started his service career as a peon under executive engineer in a Govt.Organisation,at the time of joining he was submitted all the relevant records including school leaving certificate,so according school certificate his date of birth was mentioned in service book as 19-01-1952,but unfortunately he was retired from his service according to the decisions of medical board,prior to date of his actual date of birth .whether he will return get back his job or will he compensated ?
