My boss not paying salary and threw me out of company in a day

Dear Sir,

I was appointed in a Pune based local software company as Vice President Sales & Business development around 8 months back (Oct 2014). During my tenure I was responsible for overall sales and sales operations, overall growth, define sales cycle, go to market strategy, designed service lines, new website and content, digital marketing, branding, advertising, streamlining IT services, started inside sales team, lead generation, and email campaigns. Company was badly in shape and needed quite more time to gain existence, recognition and starts generating revenue. I had a very limited resource and tight budget to execute activities; even though I was able to manage decent number of opportunities every month. It was unfortunate that none of the opportunities were able to convert into sales (revenue) due to many associated reasons. He stopped communication with me for last two months (March, April, & May) and asked me to report to CTO. Even for my marriage leave I was asked to talk to CTO for an approval. I am still on probation; he never confirm my employment.

On 24th May 2015 Sunday, my boss called me to office for a quick meeting in the morning at 10 a.m. I thought it was a normal business discussion call but it was so unfortunate day for me. He started behaving so weird. He was predetermined about throwing me out of the company with any reasons. He started raising issues related to work, sales, my duties – he told me he hired me only to do cold calling only! He created heavy tensed environment and pushed it so hard and asked me to leave saying “He can’t stand me an eye to eye” I walked off from office.

Very next day on 25th May 2015 Monday morning, I was not able to access my official email ID and I found out that my email was blocked as per the instruction from my CTO. I sent an email from my personal gmail ID to my systems admin keeping my boss and CTO in CC requesting to grant me an access to my official email. By now it was clear that my boss had made up his mind and he doesn’t want me in that office. I sent an email requesting to confirm him pay me my currant month salary and money as per one month notice so I could resign instead he terminates me!
I received unsatisfactory answer and I went to office as per my regular working hour but I was denied entry. I went straight to my boss’s cabin to discuss what the matter is! He called for a security to chase me out of office, but I defended my self-saying, I haven’t resigned yet and I am still an employee of the company. He pushed it hard and in return I had to dial 100 and ask for a police help. When he saw I dialed 100 then he asked me to stop and called me in his cabin. He lied by saying that, he will do my payment in 2 days’ time and asked me to submit all company assets like ID card, accessories, visiting cards, other documents. I did exactly the same upon trusting in his words.

Even after one week he never responded to my email or calls. Exactly after 11 days he replied sending some unexpected calculations indicating he will not pay me a single paisa. He doesn’t want to pay me for the month of May either forget about June as part of notice period. Also he threatened me saying If I go legal than, he’ll black list my profile in NASCOM and make sure nobody else hires me in India. Can he really throw me out of the company without giving me a time of one month notice period or my salary?

Please tell me what do I do? Can I file a legal case against him? What are the chances I get my salary?

Removal or dismiss from service

Dear Friends,

I had joined in SSB(paramelitry Forece) as a constable General Duty 15.06.2006 in Lakhimpur Khiri Lucknow(UP). and due to an incedent i was removed from service 25.05.2009. I had appled to DIG SSB. He is also pass the same order. Than I file a case in Patna High court and court pass order to IG for review this matter within one month but IG also uphold previous order. than I again file a case in patna high court in august 2010. Now court said since dismissal order pass in lucknow juridisction so please file case in lucknow. so, You are requested to please advise me best to best lawyer in lucknow for discuss this matter on urgent basis.

Basic pay protect

Respected sir
I was working in Shri mata Vaishno devi university jammu under UGC act 12 (b) and 12 (f)as state university thr i was working as junior engineer in same grade pay of 9300-4200-13500 in getting basic pay 16710/- after working thr i was appointed in central university of himachal Pradeash as direct recuirt through proper channel here in this organization they have not protect my basic is thr any rule so that i can submit them for my basic pay protection
please help me with some solid grounds i will be higlhy thankful for the act of helpness

about my rejoin into service

I am working in Esic I was resigned in September 2014 yet not received my releaving order,is there any chance to take back my resignation and rejoin into organisation..

Not fulfilling service bond and notice period

Dear Sir

I have submitted my resignation with my ex-employer with a 15 day notice period.
I have worked in this organization for approx. 18 months. My services were confirmed after 6 months of joining.
My notice period is 3 months of gross salary.

I have not served that so that they have not provided me relieving letter.

Another thing is I have signed a service bond there on which it is wrtten that employer will conduct a training
in abroad whose expenditure are INR 2,00,000/- (Two Lacs) for which i have to serve organization for three years.

But they have not conducted any abroad training program.


After my resignation they are demanding INR 200000/- for service bond and INR 75000/- for not serving notice period.
I refused to pay it.

Now they have filed a case in civil court. Also they are threatening that
they will send some summons to my current employer.

Kindly suggest what i will do to overcome it.

Selecting more than notified posts

Sir,
I am working in a public transport corporation as personnel manager.we have our own cadre&recruitment regulations.
As per this regulations there is a provision to prepare the select list considering existing vacancies and the vacancies which will arise during one year in future.We have notified 1881 drivers posts in 2013. It took us allmost one year to complete the recruitment process and we published the final select list 4076 drivers considering present and future vacancies during August 2014. There were 8046 eligible who have passed the driving test. But now our action taken is considered illegal in view of recent supreme court judgments( they are not giving details of the judgments)and directing us to to limit the select list for notified posts only and to quash the remaining part of the list. Sir kindly give your opinion whether the action taken by us following our rules is incorrect and is there any directions from the supreme court regarding this.

Central gazetted officer

a. A class B Gazetted officer in central service works 8 Hrs 30 minutes a day in a 24x7 shift duty work pattern. How many weekly off days he/she is entitled?

b. Whether he/she is entitled to avail compensatory off days in lieu of full day work in public Holidays?

Gratuity not received from my previous company

Dear Sir/Madam,

I was working with my previous company on outsource Employee basis. I have worked with same company for 5 Years 6 Month. But the Company has changed my outsource agency 3 times in my 5 Years 6 Month Tenure. Now i have left the company and i am asking for my gratuity because i was working with the same company for more than 5 years. But they are denying to pay.

They are saying that i was not with the same agency for more than 5 years but i have not changed the agency. It was changed by the company only.

Please help me to know that am i eligible for gratuity ? If yes than what will be the procedure, How should i fight for it ?

Regarding pf money withdraw

Sir, I want to withdrawal my PF money . I resigned from my job before three years. Now my PF a/c is inoperative.Right now i have no any contact with the company. So how can i directly withdraw my pf money.

Getting experience letter without serving notice

Hi All,

I have resigned from my current company on 27th May.Which they have accepted and relieving date given is 23rd June. I am supposed to join next company on 8th. I have mentioned this date (8th June) on my resignation also. Even after trying again and again current company is not ready to relieve me early using buy out option. My questions are,
1 - As I have resigned already, if I join next company on given date is there any way I using which I can get my experience letter and relieving letter afterwards?
2 - Will I be considered as absconder ?
3 - How can I get Form 16 and my PF account transferred ?

HR Policy and Appointment letter : My Appointment letter does not mention anything about buy-out option. It says that Notice period is 1 month. But Buy-out is mentioned in the HR policies but it is mentioned that buy-out is allowed only if management agrees.
Are you a member of any employee’s/Trade Unions? No
