Gratuity related issues

Dear Sir/Madam
I,Sujit Kumar Dash, request you to guide me on the procedure/eligibility for claiming Gratuity under Gratuity Act with my following employment details:

1. Joined, M/S. Geoffpalm Limited, incorporated in Malaysia and posted in Sierra Leone ( West Africa ) on 1st March 2013 to 31st December 2015.
2. The above company, M/S. Geoffpalm, is a group company of Siva Group, Chennai.
3. Transferred to Indian operations wef from 1st January 2016 and employed under M/S. Siva Business Management Services Private Limited at its offices in Chennai and mumbai till date.

As seen above i have completed 4 years and 9 months in the group entities,Can you please let me know whether I am eligible for Gratuity as i have completed 4 years and 9 months under Siva Group as a whole.

Also requesting you to please let me know if my company can voluntarily consider my earlier employment period into consideration and pay Gratuity accordingly.

Transfer in railway

I am working in S.E.Rly./Kolkata as a Jr. Engineer. In the year 2012 CAT, Kolkata issued order regarding my transfer from S.E.Rly to Eastern Rly & directed both the Railways to consider my transfer from SE Rly to Eastern Rly within 3 months. Accordingly Eastern Rly approved my transfer there & wanted from SE Rly in the Yr. 2013 my transfer application form with related documents. Then SE Rly issued a letter to me for submitting the said documents and clearly mentioned in their letter that after submission my said transfer documents will be forwarded to Eastern Rly immediately. But SE Rly did not forward it after submission, rather than they lost my all documents from their custody & asked another set of documents. I again submitted the same, but this time also SE Rly again lost my said documents & thus delayed the case for a long time. Finally SE Rly asked me to submit the said documents once again in the yr. 2016 & soon after submission, SE Rly summarily rejected to forward the same to Eastern Rly due to staff shortage at present. I again filed a case in the CAT/Kolkata & the judgment issued on 17.11.2017 is not clear. It is stated in the judgment that the Hon'ble CAT directed SE Rly to consider my transfer application for transfer to Eastern Rly., but SE Rly already considered my said transfer application & rejected to forward the same to Eastern Rly though they initially agreed to forward it to Eastern Rly. In response to CAT/Kolkata’s aforesaid last judgment, SE Rly now informed that after consideration my transfer document can not be forwarded to Eastern Rly due to staff shortage……..

Q-1) Can any Govt. Authority deny their initial decision just by delaying the case like above?
Q-2) From the above, now it is seen that the initial statement of SE Rly for forwarding my transfer documents to Eastern Rly is not true. Is such false statement of SE Rly authority acceptable in the eye of Law?
Q-3) If so, then in future any Govt. authority can change/alter their decision just by delaying the case anyhow, is it acceptable?

Please advise me what should I do now?

Resigning legally

Dear sir ,
My name is Rakesh Sethu NP . I am working with a laboratory where ethics is so poor but our boss is so clever to blame it on other . From past 2 years I am working as store executive but they also purchase job to me . Most important thing is our MD has given key to other person whom I suspect that has done some mismanagement. Even we have cctv camera toward the store . So recently while auditing they found some differences in the material . As always I was informing them that this is due to key which is with other person as they keep on taking advantage of the same . Now the management is blaming me for that and threatening me to pay for the difference . Please advise me what to do . Positive reply awaited from you

Benefits of back increments, others to reinstated employee .

My question is that which benefits to employee ( Court Award :- The termination is illegal and set aside . The workman is ordered to be reinstated into the service of respondent w.e.f the date of demand notice with continuity of service and with 50℅ of back wages. I joined my duty on Oct.2015 employer not give me back 21 years annual increments, I also demand these through written but they denied.They give me fresh starting pay on Oct.2015. and now I will retired on Feb.2018. can I entitled back E.L. and gratuity full back year.

Retirement benefits to reinstated employee who joined duty.

Termination of employment after my resignation

Dear Sir,
I am Sivakumar from Bangalore. I had resigned from my previous employment in Aug17 with 20 days notice period (as per policy 2 months notice period). I had discussed with my Manager and HR that I need to get relieved after 20days due to personal requirements. Even I propose to pay the payment in lieu of notice period, they denied all the ways. So, I exited from the company after informing them with reasons. I did not get my salary for 1.5 month which was on hold and relieving letters. EPF settlement also they did not process. Please advice if I have to take legal action against the company.

For an employee who has resigned within 20 days of employment, serving notice period of one day, is eligible for salary or not?

about bond agreement

sir I joined bsnl with bond agreement of 50 thousand.and I resign this job and got letter to pay 50 thousand bond.but when I asked him how to pay this.they said that bond is revised to 170000.and you pay this bond anyway.sir is this right.and what should I do?

not paying my f&f

Hello sir,
My name is rohit kumar I worked one month with idea as a sales man but I leave my job due to salary issue after complete one month after inform my manager . She is told me for f&f email send to the hiring company and you salary full and final will come.in 45 days . I join on contract base hiring company is another that is but now told me your salary not be come . BECAUSE YOU worked only only one month . I have only ICARD of IKYA AS a proof please tell me what action I can take I need this salary because I worked there aprox 35 days this is fild job so bike oil charges I pay from my pocket aprox 2500
