Rules for choosing surplus teacher

I am an assistant teacher in govt aided High school in west bengal. I was appointed in 12/09/2009 in English language group in Pass category and S.C quota.My post is normal and permanent post. Due to students roll strenght degradation in our school the govt has issued notice to our school to identify surplus teacher in English language group and has instucted to keep only two teachers in english langusge group.Presently there are 3 teachers in English language group. Mr.A was appointed in 1990 in English language group as Post Graduate teacher and post graduate scale of pay in general quota and his post his normal post. Mr.B was appointed in 1995 in an additional post in English language group as POST GRADUATE" teacher and in POST GRADUATE scale of in "GENERAL" quota.Later on 1997 his "ADDITIONAL" post was declared " SUBSTANTIVE" post after 2 yrs completion of service. I was appointed in 2009 through school service commission exam in ENGLISH LANGUAGE GROUP in "PASS CATEGORY" and Pass scale of pay in "S.C"quota( reserved category). My post is a normal and permanent post. Now on such circumstances who will be identified as a surplus teacher? According to N.C.T.E act and norms from class 5 to 8 a pass graduare teacher is to be recruited and for class 9 to 10 hons/ P.G category teacher is to recruited. On such circumstances kindly guide me who will be the Surplus teacher amongst 3 of us? And kindly clear me that in case of identifying surplus teacher is category, qualification also taken under consideration?Thnx...

Resignation in cbse norms

Hello I m doing work in cbse school. There has appointed new principal. I want to live job so I resigned with writing notice letter one month prior. But I can't give one month completely due to my study, exams. Principal has not manners to talk and she is deducting my 30 days salary. And she hold my last month salary yet. Before that this school never give this type instructions. Other teachers left easily. School management paid them fully salary. But in my case having trouble. What should I do. Can I file a suit against principal n management

regArding beneFits on removal from job after five years

Dear sir,
i am working in reputed company on third party bases for last Five yeArs and eight months.know company is removing us .

is the any law whiCh can save my job or can i file case for confirmation for parmanent job.
whAt beneFit i can receive from then if i accept there purposal as per labour law.

Resignation

Dear Sir,
I have completed six month in an organisation and as per the acceptance letter the company would confirm me at the end of six month, now that I have completed six months The company had given me letter for confirmation and I would like to resign from my service service 7 days notice as per the probationary rules I have not signed any letter for confirmation.

Please confirm if this is legally correct as I have not acknowledged letter of confirmation. And if the company does not release me what is the action that can be taken

Leave encashment during probation period

Is there any legal requirement / law governing leave encasement rules to be paid to an employee who is resigning during the probationary period (probation period being 6 months )? The industry is for a NBFC which has presence in multiple states across India.

Conveyance

Hello Sir,
My self Jayesh Bonawate.
My query is regarding conveyance.
I didn't get my last 6 months conveyance from my previous employer,
My last date was 16aug,2017 and until they didn't provide me my conveyance.
I regularly getting feedback from my sales coordinator and manager but they didn't giving me proper reply.
Now it's been 4months from I left job .
I have all recordings and whatsapp sms of related with conveyance as a proof.
What should my next step?
They are not even given me a proper response and answer that I will get it or not
Please reply what should I do sir??

1 year probation completed.termination notice issued

Sir/Madam,
1. In my appointment order signed by CEO of the organisation dated 01-10-2016 it was noted as follows:-
a) You are on probation for a period of one year from the date of joining.
b) You are confirmed in your post after the satisfactory completion of probationary
period service.
c). The Management reserves the right to terminate an employee on probation without any notice in case pf any deviance from the terms and conditions in this appointment order or found to be engaged in activities not in the interest of the institution.
2. I have joined duty on 21-10-2016.
3. I have not issued any memo or charge sheet as on date.
4. I have completed my one year probation period to the entire satisfaction of my superiors as on 20-10-2017.
5. As I have not been issued Completion of probation order even after completing one year, I have requested the Management to issue such order.
6. But, unfortunately, my HR Department has sent an E Mail on 18-11-2017 as follows:-
"As per the discussion we had earlier on 16-11-2017 regarding your
relieving, your Notice ends on 16-02-2018".
7. I have sent a reply on 20-11-2017 as follows:-
"Thank you for your mail. Kindly let me know the reason for my future
references regarding my relieving".
8. As I have not received any response from my management, I have sent an E-Mail / letter By RPAD on 13-12-2017 for reconsidering of my termination of services due to the following reasons:-
i) Kindly confirm HR Dept has got power to send intimation about my termination of service since the appointment order was issued by CEO.
ii) If HR department having such powers, kindly send a copy of delegation of power to HR department for issuing intimation of termination.
iii) There is no mentioning of period in which the original certificates submitted will be returned to me which was kept in safe custody of your trust before relieving me.
iv) Reason for termination was not intimated to me in writing till the date of sending this email/letter.
v) Reason for not issuing confirming order on completion of probationary period.
vi) Shortcoming if any in detail be informed for further improvement so as continue my services.
vii) Only on receipt of my request for issuing confirmation order under reference second cited, the HR department has sent the mail under reference third cited.
viii) Management has no right to terminate the employee after completion of probationary period without giving any valid reason.
ix) There is no indication about the probable date of refund of EPF contribution Amount since this organization is covered under “EPF exempted Establishment ” or EPF non – exempted Establishment” is not known.
viii) There is no indication about the probable date of refund of security deposit which is being recovered from my monthly salary.
ix) Under the above circumstances, I request you to kindly re-consider the issue so as to continue the job in this organization.

9. As I have came to know that its the routine they are following for many years. My seniors who have served more than 12 years in the organisation were also terminated in such fashion that too without being confirmed in the job(i.e continued as probation employee for such long duration also).

10. I may kindly be advised whether I can issue Advocate Notice to Management or approach the Labor Court or Consumer Court or leave the job as on 16-02-2017.
