our company terminated one employee with given silly reason, what action need to take by employee.
Respected Sir/Madam The SAIL Colliery division Management had provided me ad hoc employment against land with few others in Aug.2014 & promised to regularize the same under roll of company. From 02 Aug.2014 to till date i am working But they neither regularizing my service nor giving a single month salary as yet.In this context i had approached top to bottom level management as well as written to steel minister & Ministry of Labour & employment along with relevant papers under CPGRAMS. In spite of that i am still miles far away from justice. I am feeling helpless please help me out from this awful problem.
I am attaching the final page of the order issued by hon high court of karnataka . can the members advise me the meaning of the judgement.

the mistake of omitting my name at the appropriate time of interview was done by the bank.( internal correspondence obtained through RTI) because of their mistake of not giving me retrospective promotion in 2005 ( wef 19.2.2004) i missed the oppurtunity of participating in the promotion exercise of 2006, 2008, 2009.

I had join as lecturer in msbte govt aided college in 17 june 2013. But after changing management they imigiately terminated me dated on 21 may 2014. After that I had filed case in school court. Then court allowed me to rejoin the college with continuity in services and all backwages dated on 1 december 2014. dte given me the order to rejoin and termination period treat as extraordinory leave. Because of this college didnt gave me the increment for that termination period. Even they told me that because Government 6th pay rules we can gave you increment only in july. So they skip my one increment of july 2014. Please advice me for the same.
I worked in a IT company, bangalore,India for about 3 years. my notice period was 2 month, already i had 20 leaves. I resigned my duty on 6th april'18 and i requested management and hr to relieve me asap. thus initiated a mail thread with HR. On 11th May'18 (friday)HR agreed to release me next week i.e 14th may as such mail received by me stating clearly you can get release date on next week (no date mention). I fell sick and given them medical certificate for 14th may (monday) stating i am ill. therefore, i joined my new company as they have accepted my mail (medical leave)My salary was blocked from April month onwards ( which should be there as last month salary should be block for full and final statement)After few days on 23may'18 i received call notice & on 7th june i was terminated stating absconder .I was accused for wrong absconder termination.
I asked the question till date to HR to clarify the points:1)After accepting all formalities like, accepting ID cards and all relevant documents how an employee can be treated as absconder?
2)As nothing has been mentioned in any of the emails from your part that 18th May'18 is the date of relieving which was clearly written only next week.
I had well in advance given Them the resignation letter dated 6th april'18.
3)They have already deducted my salary for the notice period, that is for the month of April & May'18 & after that I was been served the letter of termination.
When I had submitted all the documents and subsequently been received by the authorities, then how come I may declared as an absconder? Till date no answer given. They clearly sated me i not serve notice period as my date for relieving was 18th May'18 and my attendance was 14th May'18.May i have right to log a case to them. Please suggest.

I have resign from my Job.As per the company notice period 3 month but i want to serve only 1 month and for 2 month i am ready to pay.But now Hr is compel me to serve 3 month notice.
As per my offer letter this is mention:
Your appointment has been done after an extensive process for an important position which requires
your skills and experience. This appointment may come to an end at the instance of either party by giving
the other a notice in writing for three months. Your relieving from the services of the Company would be
contingent upon successful serving of the full and complete notice period. Failing to do so would entitle the
Company to recover damages for all losses caused due to any shortfall in serving of the full and complete
notice period. The Company in addition to its rights to recover damages will not furnish a relieving letter in
case of shortfall in the notice period unless such shortfall has been signed off by the appropriate person in
the Company. In exceptional situations the Company reserves the right to waive off notice period at its sole
discretion.
and as per the company policy employee can pay for the short notice period and this is the sole discretion of company
kindly guide me what i can do in this situation. I am not able to serve 3 month notice period due to some family reasons.

Hi I'm writing for legal advise. I am a teacher in a private school in bangalore for the past three years and till this day I have not received appointment letter, Confirmation Letter and monthly payslips. I have only received my offer letter. I have resigned and serving my notice period. I have requested the school to provide the due Documents and the management is not responding. The management has deactivated my official school outlook account and unable too receive a reply too my request. Is there a law against this and if so what action should I take?

Actually i have joined a company in jan 2018, When i got selected i have asked for offer letter or joining letter but he just sent the confirmation mail just by saying we'll provide u later, I had a doubt on company that's why i have regularly asked for documents but they delayed, when i was working they don't have any fixed timings, different rules for payments or salaries, & even they don't pay salary on time, so nothing was good their. & When i asked for support in ramazan that i need to go for iftaar they directly refused. I have told them it'll be difficult for me to work in this condition. They told me to that they're terminating so i have agreed. I have asked for documents they refused, then i told them to send termination mail, but they told me they'll do it later. I had wait for 2 days but they didn't send any mail so i have mail the termination discussion details to my boss in which every conditions are mentioned like salary, documents, time duration but they didn't respond on mail
then i left the company & joined somewhere else. Now its almost 30 days i have continuously calling & mailing but they are not responding even they have blocked me from WhatsApp. Because of shortage of time i wasn't able to visit office.
As the time for eid is coming i have sent a message in flock (Basically an app for corporate like WhatsApp) which has been installed from the working days.
Now they are saying i have hacked & they will file against me & also refused for salary.
Please suggest something good that i can compensate my salary without delay.

1. Asking for documents (Mail to HR & Boss) with 1 reminder (Screenshot)
2. Self termination mail in which all the discussion which happened at the termination time was there. (Mail & Screenshot)
3. Delay in salary details (Statement)
4. Follow up(call details, screenshots & Msgs, Mails)
5. Link that'll prove i didn't hack any server. (Basically a flock app link which came on mobile to install & use)

Dear Experts,
I was working for Norwin technologies from 13-March-2017 to 8-Oct-2017.
I was working for a client by name BITB, and due to some process related issue the client had to withdraw the project & Norwin had to close our team. On 8th August 2017, our Director announced this news & also added that company will be paying us 2 months salary as severance package. Which means they will pay salary till October 8th 2017.
The salary cycle at Norwin is from 16th of past month to 15th of current month. So in March I got salary for only 3 days (March 13th to March 15th). April 2017 salary was paid for the period of March 16th to April 15th. Going by the same pattern, when I got paid for month of September, this was salary for period 16th Aug to 15 September. From 16th Sept to 8th October,they were suppose to pay during final settlement. However they refused to pay by giving some lame reasons. After a constant followup & escalation till CEO level, they called me to pay the final settlement, but paid only till September 30th. They said we are doing favor to you, take it or leave it, this is what we can pay. As I was in very desperately in need of money to pay my daughters school fee, I collected the cheque, but also requested them to consider to pay for remaining 8 days. Till date I have written many emails, also escalated the matter to CEO again, but no response from their end.
Can you please guide me what I can do now to get my remaining 8 days salary?
