In a particular central govt department DPC for promotion in senior level of group A officers could not be held for consecutively 4-5 years due to administrative complications. When employees approached court , Court ordered to conduct DPC for vacancies in those vacancy years and give promotion. Suppose for vacancy year 2012-13, an officer is in the consideration zone . But this officer was issued a charge sheet under rule 16 for minor penalty ,say in September 2011 . His penalty order for withholding of one increment for one year without cumulative effect was issued in June 2013 and currency of penalty got over in June 2014.As per Court order DPC is proposed to conducted now in 2018 for vacancy year from 2012-13 to 2016-17.
My query is - DPC will consider his promotion from which date either 01.04.2012 or any other date . It will be a notional promotion or actual promotion. Is there any specific O.M. or guidelines for DPC to deal with such situation. If he is not given promotion from 01-04-2012 , will it not be a double jeopardy ,because in such case he will loose his seniority . If any Tribunal/Court decision exists for such situation,kindly appraise . Thanking you all in advance.
Dear expert, We are a manufacturing industry received service from A ltd for dismantling and erection service. The gross value of the invoice is 5700000 rs and charged IGST rs 1026000. The net value is 6726000. He has mentioned in the invoice is to deduct 1% amount ( 67260 ) under BOCW act. In this case i have some doubt, Please clarify it.
01. Is GST applicable on rs 67260 or its exempt from GST.?
02. Is we are ( manufacturing industry ) liable to deduct & remit the labour cess to govt.? if yes, we shall issue or maintain any forms.?

I want to know whether Maternity Benefits Act, 1961 is applicable to me for central government employees.
Can I ask for EL conversion to ML based on MB Act, 1961 now?
Honourable Supreme Court has dismissed ONGC SLP in the year 2015 and ordered to implement Gujarat High Court Order. In the Gujarat High Court Order I am also one of the beneficiary but ONGC refused to consider my appointment. Now I had filed SCA in Gujarat High Court. I wud like to know whether can I still appeal before the Supreme Court for implementation and execution of Guj High Court order.

I got selected for public sector bank where it has mentioned in its advertisement that applicant should must be completed minimum two years post qualification experience in trade finance immediately preceding the cut off date that was 10 January 2018 and advertisement application wasissued in third week of December 2017 but I completed my post qualification experience for two years in trade finance in August 2016 and after that this trade finance department get closed and I was from August 2016 shifted to new other department not related to trade finance till now. So, I want to know whether I am eligible especially as per IMMEDIATELY PRECEDING word used in advertisement ???

I have been working as a Medical Officer in one NGO Hospital since 17/2/2014 to till date.
As per the Appointment Order issued, Notice Period has been mentioned as Two Months on either side. It may kindly be noted that there is no practice of mentioning Retirement age in the Appointment Order even for freshers. All staff, irrespective of the cadre are entitled for 09 days Earned leave and 21 days CL. Un-availed leave if any, shall be lapsed at the end of the year.Working hours will be 9:00 am – 5:30 pm, 6 days a week.
On 24/07/2018 the HR Dept, has verbally informed me that the Management has taken a decision to Superannuate/retire me in view of my advanced age (65 years) hence, my Resignation Date will be taken on record as 30/09/2018 and accordingly, the HR Dept has served a letter mentioning my last working day as 30/09/2018 and has taken my acceptance. Kindly note, till date, I was not insisted submission of Resignation for my position.
