Sir,
I filed two separate applications u/s 13 and 24 HMA for my client (wife) of the defendant (husband). The court ordered him to pay rs 2000/- per month from the date of application and Divorce petition is still pending. It's been more than a year passed but the husband has not paid a single rupee to my client till the date. Help me how to file recovery, like we can file 125(3) for maintinance granted in 125 CrPC.

respected Seniors pls ans me i hav filed divorce and wife has filed hma24, and got interm maintenance of 8000 frm date of application, I appealed in Calcutta high Court but got no change in order,
Now if i go for revision in high Court tht d maintenance shld b frm date of order only, is there is any chance tht i ll get success?

I am a working woman in noida.I am married for about 4 yrs in Sirsa,Haryana.it was a love cum arrange marriage.I was being forced to give money prior to and after my marriage.i resisted this for a number of times but then because of fights and emotional blackmailing and abusing I continued giving money.in this Jan 2017 When I was 8 months pregnant I stopped giving him money than he called up my family n said ki aake le jao isse,m iski responsibility nahi utha sakta,my family said ki tum chod jao hum lene nahi aaenge to he pushed me out of his home.Then thing settled a bit I continued living with my husband again till my delivery but he n his mother made it hell for me,there was no grocery,no milk for me.after seeing all this I decided to come to my parents place after 10 days of my delivery after consulting my dr as mine was c-section delivery.I thought everything will be fine after sometime but then my husband shifted the flat and he is not giving me the address and keys of my house .He and his family is constantly pressurising me to give my salary to them only then they will allow me in.Ab mujhe darr lag rha h ki kahin ye log mujhse mera baccha bhi Na cheen le to is case mein mujhe kya krna chahiye.As my maternity leaves are about to end what should I do now.I want all my money back and security of my child as well,so that in future he cannot take my child away from me.i have details of transactions which I have transferred to my husband's account.

Hi All,
I am a lady of age 65 with running case with husband since 43 years...Now i am having the situations described via below facts..This at the uttar pradesh, dist kanpur..
Facts-
1. I was married in year 1981.
2. Marriege were broken and case were proceeded upto now.
3. In between i was at my father home till now without getting anything from husband side.
4. Year 1995 a property has been buyed by my father with my name.
5. Later in 1997 i transferred the power of attorney to my father.
6. I was liVing with my father in between i shifted with whole family in my younger brother house.
7. In 2013 my father, mother, youger brother expired.
8. Just nows few days back i was asked to leave the house forcefully with abusement and misbehave by my widow younger brother wife after putting and axditional lock in my locked bongings in room.
9. Currently I am searching the staying option as the rented house.
10. My father were having patental house , additional the house which was transferred by me via attorney transfer.
11. My elder brother with my younger brother widow wife wants to kick me out from the all property.
12. As per law all daughters are having right in father property also.
13. My father left us without any vasiyat.
14. My another brother may perform some fake vasiyat or some other conspiracy to create his complete right to kick me out.
15. My another younger brother locked the old parental house in which i was satying earlier.
16. If i stay with them they all trouble me to make me leave the house.
17.I am having the risk of my life/Belongings till i am residing in my dead younger brother house with his widow wife.
18. Even after asking mtitimes my another younger brother does not provide me any information regarding the current status of any of father property or belongings.
19. My another younger brother wants only his 100% control over all property , money, gold etc. He wants to kick me out via any legal or illegal conspiracy by creating some fake legal papers , misbehave , abusement etc etc.
Now kindly do suggest what i can do legally to live further at the earliest.

Respected,
I got married to this girl on 08/2008 as per Hindu Marriage. We both are Australian citizen now and separated on 12/2014. We have a son from this wedlock born on 04/2013.
After our separation I came to India and she stayed at our place in Australia for 9 months and came to India on 09/2015 and went straight to her parent's place. We met once after that in a restaurant and some times in the court hearings.
After our 1 year of separation I filed divorce case in Australian court and served her with the required documents. She has filed the response of those documents to Australian court and immediately file Crpc 125 and Sec 9 here in Indian court. Court in Australia granted divorce on 24/11/2016 which she went on for a appeal. On 22/02/2017 she filed Domestic violence case with all those 18-22 against my family including my uncle. Australian court discarded her file of appeal on 07/06/2017 and passed a decree in favor of me. She can not go to any higher courts in Australia any more.
My questions are:
-Can she filed DV after 26 months of separation and even after divorce?
-Is this divorce are valid in India? (We both are Australian Citizen including our son and she did appear on the court in Australia as well as her appealed was dismissed as well.)
-She has done some fraud in Australia and that is the reason she doesn't want to go back otherwise she is entitled to $1500 pension being single mother and $400 for being carer of a son.
-I am happy to pay all the expenses of my son but she is not even allowing my son to meet me.

We son mother father live together in house for 25 year.after son marriage.
Behaviour of father towards daughter in law and mother changes and very abusive and very problematic
In 2016 daughter in laws pregnant with the month of 9 and problems are very very high which is not tolerated by son and daughter in law so they decided at the stage of 9 month to change residence for the quality of life
At the same time mother is also not tolerate things so mother also decided to move with son and daughter in law at new place as the period of 9 month is so much critical
At the month of August son and daughter- in- law is gifted by newborn son. After 10 to 15 days of leaving residential home father called son and mother many times and say sorry and accept all mistakes
( Will be not able to explain all mistakes but biggest is that he doesn't wear any cloth when son is not in home)
For this conversation of saying sorry and accepting all mistakes son have all recording where he accept all things . he also admit that he is in pressure of grandfather.
After that phone call for the sake of relation mother went back to property with father
After going back mother think the relation of father and mother will be better and hassle free but tensions are more and more father acquire all gold all money from Mother some times father and grandfather beaten and threaten to kill son and her.
After that husband pressurized to sale residential home and move to grandfather place which is not accepted by mother as we have many complaints from many womens regarding grandfather
so mother denied to move
After denying father pressurise mother to move to another location so many problems and when things are not tolerated mother moved to son place.
Now we all son mother daughter in law and small child live together in another place.
Few days before we got to know that father and grandfather is going to sale our property where in 2014 son invested 2000000 rupees in same property also from starting 24 years mother invested so many money in that home where father is not able to invest and earn any single penny now we want to know following points
1. Mother share in property
2. Son share in property
3. Can we take stay on that property
4. Can we put any type of case against both of them where they give some problems to my wife and mother.
5. Can we get some share that we invested in home son invested 20lac and mother invested all money what she earn.
