Hello
This is wrt infant child custody who is female 8 months old now. My wife is in SBI working as clerk having salary 25000 and my self in merchant navy having salary 2.5 lakh per month. My wife was working in SBI just 3 km from my place. Now she has taken transfer near to parental place which is 150 km approx and without informing me. I have applied for RCR and awaiting for hearing. Mean time I wanted to apply for infant cuhild custody u/s 26 but some lawyer suggested me that up to 5 yr mother is natural guardian and custodian so its of no use but still I want to apply on some facts
A) my wife is working in SBI and her father working in PNB and her mother is living with her elder daughter at metropolitan city. So most probably maid must be looking after my daughter. So I confronted my inlaws if maid is looking after my infant baby then you give my daughter back as we were looking after her previously but they told me I must leave my permanent residance to look after my daughter if I so care.
B) I have my own permanent residance and my mother with me and after birth of my daughter we were taking care of her nicely.
In this scenario should I file child custody u/s 26 ???? Considering above situation who is Best suited for child custody ??? If I file for child custody then is it necessary for her to appear in court or she can skip saying that she is working and can't come with infant baby ???

Dear sir, since long time I m living alone from my wife and filed divorce petition which is running. As years passed, I formally married another woman who also living alone from her husband since long time and without divorce. Within 3 months there are serious misunderstandings between us and now we decided to separate . she is demanding huge money otherwise threatening to file police case and report to media. though I offered reasonable amount she not accepting it and threatening me dire consequences. In this situation what remedy is available to me please advise

I need some advice here i got married on march 2016, From that day till now i am not living with my wife our marriage is not consummated. I was pressurized for this marriage by girl and her parents because of life threat to my family. i requested girl for divorce previously she agreed now she is saying that there is no benefit for her. she stays with my family and i stay in other city.and her family is threatening me again and my family that they will murder whole family. if i dont consummate marriage and stay with her.
please help how to file divorce or separation.

Hi,
Can someone pls provide me info about anticipatory bail? Can anticipatory bail be taken by accused even before the case has been lodged by the victim? One of my acquaintance has been beaten up by her husband and in laws. She somehow managed to call police and her inlaws were taken to the police station. However she didnt file any complaint as they apologised and assured that it would not happen in future. Now as they are aware of the sections under which they can be booked in the future, can they take anticipatory bail prior to lodging of complaint by the victim in the future?

Kindly, Resolve/let me know Q 2 specifically.
Q1-What legal safeguards/actions I should take against purely sexual chatting on whats’app by my wife with a person whom I don’t know. These chatting’s in her mobile is in my possession. Also she has been cruel in routine life, maybe because of deficiency in her mind due to any hurt in childhood since marriage. I have two baby child of age under four years. Marriage is 5 years old.
Q2-Can,For the time, I file an FIR only against the person with whom chatting is done as this person has threatened me when I called at the number to find his identity and objecting this all.(Note my wife has been equal responsive to reply to his messages received)
I will appreciate your valuable advice.

Hi,
My wife had left house on 12th March 2016, till date she has never turned up,
She went off with a verbal clash with our family (she was few days close to confirm on pregnancy so we had asked here not travel which may affect your pregnancy, for this she started quarreling for more then a couple of days, and went off saying that she don't want to live with our family).
Above said is an incident happened before she left us. but there were many such conduct of her daily fighting with me and my family and asking me to coming out of family to live separate, she was not caring our parents and wanted not preparing food. (she was getting in fight with my parents without any respect).
Now its been 21st month she has never turned, and i am feeling i have waited enough so decided to file Divorce.
Need your guidance to file it in proper way.
1. Married on 06.04.2017
2. She left home on 12.03.2016.
2. we don't have children's.
3. she don't want to live with me.
4. she don't want to live with my family (Parents).

My wife hv filed divorce petition in Mumbai u/s 13 (1)(ia). She also filed application for interim maintenance u/s 24 & 26 for her & child. After 1.5 years we both have decided to go for MCD. In mediation I agreed to pay RS 6 Lac for my child (to be invested by her in FD in nationalize bank & interest of the same will be utilize for child exp.)& she agreed to give visitation to my child once in a month. . On the next day (after one month) her lawyer refused to file even amendment application (u/s 13B) & consent terms also. She insisted us to first deposit money into the court & then we can file amendment application & consent terms.
Please advice
After depositing money in court, if she not agree with some terms e.g child visitation & depositing money in child name nationalized bank (with husband & wife guardian so that she cannot break the FD), what is the risk to me. Can I withdraw my money deposited in court if she is not agreed to the certain terms & conditions.
Fathers name change
I am married to Gangu Todalbagi she had a girl with other person without marriage now she is living with us. And on the date of birth certificate the other person name is there. so in school they are entering the name of father as The fathers name.
we want that the name of fathers should be mine.
Is there a process Legal to do so.
So that we don't have problems in future
