Respected learned counsel,being an advocate i am appearing for the applicant i.e.wife and the five months have been passed but no order of interim maintenance is granted by the court then on the last date i have moved an application for interim maintenance and application for protection order also and the court has told other side to reply by the giving the verbal direction to husband that do avoid any violence against your wife.so in the next date which is on 12th december 2017 what will be my role on that date should i again stress on interim maintenance or should i make an argument what should i do please hlep me

I am Muslim married women. An only child of my parents. My both parents were earning but all the properties are in the name of my father only. My mother died and my father got re-married but with no children further. He has already transferred all the monetary values (money) from my mother's account into his account. Now that, the property is also in his name and he has got re-married. What shall be my share in his property? and How the same can be divided?

Hi me and my souse were married in India , lived in uae and I travelled to USA for work and she abdanoned from uae with my child .
I have no idea where she is and her parents say we don�t know either !
It�s been over 2 years now and I found out she went to India as I checked immigration from uae .
Now being a non Indian citizen now ( earlier I was Indian pp holder)
Can I get divorce if I file from overseas? And since I don�t know her address where do I send the notices?

Hi wrt to.following fact I want to put before family court for RCR defense
1) my wife left our home along with her father saying she will return in 15 days and that time she was working as clerk in SBI branch near my home just 3 km in city.
2) from her parental place she applied for transfer at her request to.parental.place without taking permission of husband.
3) she informed only when we asked her why you are not.coming.
4) SBI has transfer policy ie married women should be transferred near to husband place as possible or vice versa and unmarried girl near to her parental.place.
5) she had joined SBI branch at my place on spouse policy just 6 month back.
6)even branch manger is transferred after 3 yr on routine category or in case of emergency while sub juniors like assistant clerk can apply for.transfer after 5 yr of service in particular branch
7) my wife gave DV by inlaws as a reason for transfer which is wrong as she left with her father.
So can these point be useful to fight RCR case as my wife clearly saying she cant live with husband and MIL at our permanemt residance and forcing me to leave my place and mother

My husband was an Asst. Professor of VNIT-nagpur(autonomous central govt engineering college). He joined VNIT in July '2016 and died on November' 2017. VNIT told me neither i will get any compassionate job nor any pension due to New Pension Scheme. My in laws and i have no source of income, we are 6 family members (great grand mother of my husband, my father in law, my mother in law, myself and my two kids (9 years and 5 months old) who were dependent on my husband. Now i want to know what can i do to get pension and compassionate job.

Can a relinquishment deed be executed by an apparent legal heir without the title document? without succession certificate? even when there was no will and case for partition was pending?
What stamp duty must be paid for it to be valid?
How to prove the that a relinquishment deed is void.
Facts of my case:
The RD was executed by old widowed and uneducated mother relinquishing her right in the property of her late husband in favour of one of her son.
The mother has alleged that the RD is forged in her affidavit.
The mother is no more alive. According to her will, I should get her share in the property.
Legal owner's definite share in the property is not ascertained till date as the case is going on for about two decades now.

My mother have land it's comes from my grand mother we have 2 sons and 1 daughter for my mother. My sister is already married she gave rights in that land

Dear Sir, i am a Hindu Brahman guy. I have filed a Divorce case 2 years back. after that my wife logged 2 complaint i.e. at CAW Cell and another one of Domestic Violence. Both the cases are in process.
After 1.5 years, I have started giving her 10,000/- on month basis as a maintenance charges.
she is not willing to give divorce. Please help me to understand few questions.
1. Is this situation will remain same till the time she didn't agree?
2. Is there any law which i can peruse for further action in my favor.
3. Can i marry again (if there is any option)?

Matrimonial Dispute Seeking Relief/ Divorce
Dear Expert
I have been married on jul 2011. I've one daughter aged 5 years. I and wife are living separate since 2014. My inlaws had filed FIR under 498A and Domestic Violence case in Agra for my family. We had taken Bail from Agra court and send petition to ALLAHABAD HC for relief. Thereafter we had gone through mediation in ALLAHABAD but in vain. And DV case is going in Agra court. I'm giving maintenance to wife for last couple of years via Agra court.
Issue : My wife & inlaws are not ready for any compromise. Truely speaking they are expecting atleast 50% of our house cost and nothing. They are harassing us continously. I used to go to Agra court regularly on dates but as she is local to Agra she would not come.
Advice : I am seeking legal advice on how to get relief from them. I want divorce but they are not ready. They only want to harass us and looking opportunity to send my wife back to our home for torturing us. I have only mother as my father got expired. I have 1 sister who is married and no brother. Can we get DV case transferred to Ghaziabad court from Agra so that atleast they do not make fun of law & court...and i get little bit relief...?
Secondly is there any way to get permanent relief from them?
They are worst people w/o any sense as they do have any good intentions they want only money from us. They are inhuman and want to snatch our house.
