Hi, please give me your valuable advice I got married 2 years back, I have no child. Since starting my wife dominated me. She doesn't respect me and my family members. She uses abusive laungage. Many times she has beaten me. She threatens of police complaint. I have been totally mentally disturbed. Now me and my family doesn't want to keep her. She is trying to trap us in false 498a case. Also putting false allegations which have no base. No one in her family is read to talk. How can I get rid of her. Should I apply for divorce, how long it will run in court. So far no FIR has been registered from either side. She has created false evidence of dowry by using my social media account and trying to trap me and my family members. Me and my family members have also got life threatening statement from her family. Also my wife has texts me so many messages, in which she has put so many false allegations on me and my family members. Such as I have relationships with another women, I ask for dowry, I and my family beat her. again again she messages me like this. These all allegations have no base and truth at all. Because of her false messages I get mentally disturbed. I am also in terror. Please suggest me right direction.

Hi.u/s 12 dv act,session court order to me maintenance 12000pm,rent 6000pm, medical6000pm , total24000pm.wife filed crpc128 for recovery 8lacs on that order.Then HC partially aside medical 6000pm.& order 18000pm. So 4 lac recovry now.my Q (1) wife need to filed new case of crpc128 on HC order??(2) wife asking recovery amount on same old crpc128 case? Which one is right or wrong? How?why? Thx

Hello .
I am Subhash residing in delhi.
I was facing cases of DV act, 498a and 125 CrPC. Then my wife's lawyer approached me for mutual settlement. I agree and she took all her cases back and we got divorce decree based on mutual consent 2 months back.
In settlement deed it was mentioned that she will have the permanent custody and I will not apply for custody and visitation rights in future, I was under pressure of all those cases so i agreed.
Now i want to file for visitation rights of my child. Is it possible ?
if yes on what ground ? ( Child is 8 year old ) Please guide.

This is regarding the custody rights of my son. I got divorced mutually in 2014. As per the petition my ex-wife got the custody of my son. As per the petition she also agreed to no financial help from me however for the last three years I have been paying a monthly amount to her and also the school fees and other requirements are bourne by me. She remarried in 2014 and now has a daughter from her second marriage. My son feels neglected with her also she is at times very violent. My son is terrified of her but is also scared to say that he wants to stay with me. His studies are also not taken seriously. He comes and stays with me during vacations though visitation rights were not mentioned in my divorce petition. During his last vacation he did not want to go back to his mother. Me and my ex-wife stay in different cities due to my job. I am not being able to shift to the same city as there are no opportunities. A custody battle will take ages and I can't see my son being tortured. I have started speaking to her regarding getting my son to me. She agrees once then disagrees after a few days. Is there any way I can bring my son to me without going to court. What legal steps can she take if I don't send him back to her after his next vacation. How do I fight it? Cannot see my son go through this trauma. He is 10 years old.

Before which court of law, a Muslim husband can file restitution of conjugal rights and under which provision of law the said court will have jurusdiction to entertain the restitution of conjugal rights suit????

Hello sir,
I filed a complaint against dowry on my husband in paramarsh kendra, police called them and they came but only 2 times and now after 3 months they sent my report to near my poilce station to FIR against them but now 2 months passed no single call no enquiry has been made by them
Please advice me what should i do further

125 recovery case
I have filed 125 for maintanace of my child but my husband stopped to pay the amount since 14 months court issued warrant but he ran away from the place he resides now what steps I need to take. Police don't support me. And they take money from him and wrote that he is not at home. Please guide me. As soon as possible
