Non-Bailable Warrant

Hi,this is regarding Non-Bailable warrant which has been issued again my father who is Govt officer in Central Govt.Warrant had been issued from Darbhanga and we do not know how to go about it.kindly guide us through the process.Lot of people have bene saying different things on this.since it is non bailbale waraant,we would not get the bail in District court etc.we are really frustrated at this moment.Need your answer ASAP.Thanks alot.

Dishonour of Cheque

ABC,a Private Limited Company has two Directors namely Ram and Sham and issued a cheque signed by Sham for RS 50 Lac to XYZ a Private Limited Company without the knowledge of Ram . Cheque was Dishonoured.
XYZ Filed Suit on ABC and on Ram and Kishore as directors, whereas Kishore is not director of ABC. Sham who signed the cheque is not made party. XYZ in suit says that the said cheque was received towards repayment of Loan given to ABC. Though XYZ had given a cheque of 50 Lac to ABC BUT XYZ is not able to lead any evidence that the amount was towards Loan despite asked by the Court in the past 5 hearings at the instance of Ram, who says how such a big amount is given as loan when his company ABC had no dealings with XYZ right since incorporation.
ABC is not doing any business for the past over 6 years and its records are destroyed during Labour dispute and strike.
What is the position of ABC,Ram,Sham and Kishore(who is not director)

Which Court've the jurisdiction to grant or refuse Anticipatory Bail?

Which Court've the jurisdiction to grant or refuse Anticipatory Bail?
i.e. If the offence has been committed in B state and accused residing in A state, whether the Sessions Court or High court of the A state having jurisdiction to decide Anticipatory Bail application.... your views pls... Thanks.

my exwife filed a FIR dowry,abortion,remarrying....after 2 yers of divorce

my exwife filed a FIR dowry,abortion,remarrying after divorce(never mentioned divorce in FIR but later on admitted divorce when i submitted the papers to police)
..........but police in enquiry couldnot make any case in dowry,dv.
but they made rape case against me and my family(pretext of dissolution of divorce which was taken by her on mutual consent in her jurisdiction) .wheras my wife was staying with me after divorce of 1 year(june 2009) to may 2010(now deliver baby on 2011 jan)

charges are 376/420/313/511/120-b
can i go for quash(is it improved case)

Note ....attached is the FIR

I never asked her to laeve,she left my house for her brother marriage..........never returened back.........she left my house in may 2010 and case has been filed 11 oct 2010.

wheras i went punjab to bring her back in sep 2010.she didnt come back.i have tickets of her and i booked 1 sep 2010.

can i file quashing of my family members which are included into case

N.I.Act

Notice u/s 138 issued from place A and complainant's and accused address and their respective bank is under the jurisdiction of B. Now the case file under the jurisdiction of A. Is that case is maintainable.

cheque returned case 138 NI Act

One cheque for Rs.6,00,000/- was presentedin my accountin which payees name was altered without authentication by myself, returned by the Bank for the reason that : OPENING BALANCE INSUFFICIENT
Party has complained against me in court under 138. The payee is not known to me and there is no transaction happened between us. Now, what to do in this present situation, please advise and guide me. Case is now in court, no proceedings are run, only dates are given by the court and I have attended it.

criminal trespass and restraint

My cousins fixed wooden posts in my courtyard a month back and started tethering cattle. On lodging a complaint, a revenue official made survey and submitted a report confirming criminal trespass to police authorities. Recently when my cousins started piling up cowdung in my courtyard, it was opposed and not only the cowdung piling but the wooden posts were also removed.

Cannot I lodge a complaint against my cousins for their acts of criminal trespass and wrongful restraint on the basis of revenue official's report though the trespass has been removed as of now?

138 NI Act - Case Filed after Limitation Period

I am involved in a false 138 ni act case which is pending in the court for more than 6 years. We have many documentary proofs to prove that it is a false case. However, recently we found that the complainant has not filed the case in the court within the stipulated period of one month from the date of cause of action. In fact he had filed after four months. Our advocate could not locate this mistake earlier. The complainant has also not filed any petition for the delay. Instead of going through the trial and proving our innocence, can we go for a direct quash of the case in High Court? will it be admissable?

Procedure of polygraph/brain mappping/lie detectator tests.

Can an Investigating Officer (IO) put a suspected person for undergoing polygraph/brain mappping/lie detectator test without getting permission from the nearest magistrate or without arrest ?

What is the procedure before & after conducting polygraph/brain mappping/lie detectator tests. Pl. state the relevant provisions of laws/directives.
