Under section 138 ni act

sir we have filed a cheque bounce case on a borrower.but he has changed his address before we file the case and not receiving notice. this is happened since 6months . nobody are attending court both complainant and accused . court has mentioned 1 last call in the last proccedings as per ecourts info. what will happen does it will serve warrant against accused or what action court will take. as the accused is not available to intimate we are also not attending court since 6 months.

Charges u/s 353,504,34

Police constable falsely framed charges we had argument with rickshaw driver for over charging constable came and intervened in between in civil clothes. we have video recording of this incident we have filed for discharge and mentioned about recording.will it be accepted during discharge argument or u/s 173 (2) should we file report and submit our recording.but we don't want to give proof to police who have not heard our side.

Limitation to serve legal notice

In how many days a payee(complainant) who has got the bank memo that the cheque he wanted to encash has bounced due to default of the drawer. can file a complaint u/s 138 NI Act ? If the payee fails to serve the legal notice within 15 days of receiving the bank memo, does this bars him from filing the complaint ? if not please suggest the remedy and precedent cases.

women involved in kidnap

Dear Experts,

2 women and 4 men's are involved in kidnap case FIR also registered 323,363,506 & 149 IPC. Moreover in CCTV footage women's are not visible or I can say they are in car. Police are not arresting the women's on the ground of women's are not visible in footage. There are the planner of crime. Two of accused person giving statement that women are with us.
1) Even women's are acknowledging that we are in kidnap, but we didn't hurt the petitioner.
2) How can I prove that women's are in crime???

Misapproporation of money

Hi, In my company, Employees needs to visit the outlets/Retailers, have to take purchase order and need to collect the cash. every day 1 employee will visit 20 outlets and will collect more-than a lakh rupees.

Some Employees would ran away with collection money Approx 50,000 to 2,00,000 Rupees.and will abscond, suggest me for some Preventive measures, or how to handle these cases., which will help to file FIR against employees.

if i take a Promissory note from them, will it be helpful to file a case. because employees also will have the fear that they signed promissory.,


Kindly advise me on this.

fake experience certificate

I want a job in BPO sector and they demand for one year experience certificate ...if I get a fake one year experience certificate ...and submit ...than..do these people inclined??
And if they gets to know about it then does they takes any action against me???

FORGERY

Coming to facts Sir,That the accused had changed the DOB in the photocopy of SSC memo for applying of passport,But not in the original memo,which was submitted to authority.He was charged with Forgery.My doubt is that Whether the alteration made in the secondary evidence i.e(Photocopy of memo) is a forgery.

Accuseds are u/s 304B 498A 34 IPC

In this case all of accuseds are arrested and one child (8 years old) who is also detained with her mother her mother is one of the accuseds . Police reported the child is lapping child. We apply 439 two times but rejected. And apply a petition on behalf grand mother before the C J M for

Section 279 and 338

This is for my friend. He was driving when a women walked right in front of the car. She had an injury on her foot minor fracture and a cut. He took her to hospital and called the women's husband. After the husband came he left. She went and lodged a police complaint and my friend was charged on 279 and 338. The first hearing is in february i have the below questions

1. can my friend do out of court settlement with the person injured.

2. what will happen in case of out of court settlement as i read somewhere that 279 cannot be quashed even in out of court settlement by sessions court and need to be done by high court.

3. what are my friends options is out of court settlement best option how will he be free from both 338 and 279?
