Hello experts
In 2014 a teacher from our school was booked under POSCO.. he was sent to jail then suspended from school. I was a member in that inquiry against him (not presiding officer ) and the board recommended his transfer so that the child could have a stress free life in school. In between the appellant's wife whenever she visited used to meet all the teaching fraternity including me. And was trying for out of court settlement with the family of the victim in which I and some senior teachers used to accompany her. In between me n my husband got us distanced from him when we heard him passing lewd comments on some lady teacher's character even we had a little argument with him also on that. Then the appellant got his headquarters also changed and I also got transferred from Himachal to Bangalore. Now today I have received a summon from session court Himachal (which was sent to the school in Himachal and from there it has been forwarded through fax to Bangalore)to appear as a witness from the appellant's side.
My query is
1.Without my consent can the appellant give my name as witness as I was not witness to the incidence just an enquiry member from school side as usually it's the presiding officer who is called as a witness?
2. Can I send my statement through post as now I am transferred from Himachal to Bangalore N moreover I don't even remember the inquiry we did?
3. Most important I am of no use to the appellant if I go as witness I won't be able to testify in his favour?
4. If forced to attend the hearing who will pay for my travel expenses from Bangalore to Himachal and how can I claim it and what about my absence during that time am I supposed to take leave or I will be considered on leave.
5. Please advise.

My father got some ancesstral Gramakantham landed property from his grandfather.Being an employ he left the village to discharge his duties. He was passed away in the year 2009.After his death ,I came to know,my paternal relatives occupied the land.I asked them to quit the land as it is being inherited property. But, they are not vacating the land and asking proof of document for the land. I donot have documental evidence for that land.In fair Adangal as it is showing as owner of the land is showing as Gramakantham.

i joined army as short service commissioned officer in 2008..and got married in feb,2013 thereafter...i got approval for permanent commission on july,2013 but in betweeen my wife committed suicide and a police case under section 304-B was registered against me on 10th july,2013..my permanent commission was supposed to get effective from 20th sept,2013 and since this incident happened approx 03 months before the effective date so it was put on hold till the pendency of this case....after 09 months from the incident date a letter was issued from the army Hq as "speakiing order " to me iin jail that u have been released from service as ex- service man and since this case is pending against me ....so whenever u get exonerated from this criminal case u may approach for the re-iinstatement of service...
Now ....after two months i got convicted by trial court under section 302 and not 304-B...acutually a viscera sample of my wife was sent for analysis and the report shows "Organophosphorous poison" and based on this report only the trial court convicted me under section 302 IPC for life imprisonment....
now i would request you to please clarify me a very simple question/clarification that:
assume i get acquittal from this case by high court then will i get back my job along with back wages and full promotion as on that date with interest or it depend upon case to case matter...or any other reason please do specify....with regards,
Hemant

Complaint Case 156(3) can be carried forward by son
Dear Sirs, I am from delhi. My father died on 14 Dec 2017. He had filed 02 complaint Case against our tenant in 2007 & 2008 apart from civil suit. Now, as he is not in this world I want to continue these cases being his son. My lawyer told me that as per law I can't carried forward in criminal case as I was the witness in above 02 cases and law is also not allowed to carry forward in criminal case. Now my query is as follows:
1) my lawyer is correct?
2) we should withdraw above 02 cases?
3) will withdrawal of above 02 criminal cases have negetive impact on existing civil suit?
4) If in case I am allowed to carried forward the above 02 cases, should I continue as it is pending since 2007 & 2008 only?
5) Can I carry forward civil suit after my father.
Please advice . Thanks
