Respected Sir,


Subject: Maintainability of an Un Registered Xerox copy of Will:



“A” is the Sister of B and C. B and C are the brothers. A and B are died. Now the wife and sons of B are claiming 1/4th share on the basis of a Xerox copy of an un-registered will duly executed by A in her life time. The Legal heirs of B now instituted a civil suit for partition and a separate possession on basis of the above will. Whereas C is defending that there is no will executed by A in her lifetime and it is a concocted one. Hence C is praying the court to dismiss the suit. Actually Legal heirs of B have filed the above suit on a Xerox copy of un registered will. And they are also further stating that B and C and the father of A have purchased the lands in favour of A. In this we are for C.

So in this, I want to need ur opinion.

1. How the suit is got numbered on the basis of a Xerox copy of un registered Will Nama.
2. How the suit is going to be dismissed.
3. Is there any judgments against this case.
4. Is there any possibility to dismiss the suit at the trial stage?

Eviction of tenant

I am had a problem with my tenant who threatened me and abused my daughter over parking space. I asked him to vacate but refused. My daughter filed a police complaint and he was booked under Harassment of Women act and remanded and now on bail. He and his wife and kid are staying elsewhere but have not handed over the keys and their furniture is inside. He has not paid any rent for 5 mths and his deposit money is exhausted. His wife a doctor has filed a complaint to the SC- ST comission and humn rights commission against myself and my daughter for which inquiry is in progress.
How do i evict this tenant and get back my property? How long will it take?

i am living in a lig flat first floor around 15 year ago i puchased this flat one i was out of station with my family that time my ground floor neighbour illegal cover the area of front where my meter are also fit by dda. when i come they covince me by saying there promblem of income and they want open shop there. and they promised to give me key of front gate for meter reading. but after some time they sell the house and new neighbour make this house fully commercial godown and he also denies to give key . give your valuable opinion with solution

Share in property gifted by grand father to elder brother

My grand father had substantial land which he was inherited from his father/grandfather. To avoid land ceiling in Bihar in 1969, my grand father gifted 5 acres of land to my elder brother through registered gift deed which was known as Attarnama. At the time of gift my elder brother was 9 years old and I was not born. At that point of time my father had 4 daughters, one son and my uncle didn't had any child. At present my father and uncle are quite old, they have separated in all respect but they are not able to resolve the separation legally on paper. After death of my grandfather, my father had agreed and given possession of 50% share to all parcel of land to my uncle including 5 acres of land gifted by my grandfather to my elder brother. But my elder brother is not agreeable to give any share/right from 5 acres land either to my uncle or to me. My brother attitude has been delaying family partition. Though gift deed (attarnama) specify name of my elder brother, after my birth in 1971 my father started giving land revenue ( in respect of 5 acres) jointly in my brother and my name. Land revenue receipt (Malgujari receipt) reflects my and my brother name jointly.
Question :

(1) Can my uncle get 50% share in the said 5 acres of the said land through partition suit by making gift null & void as my grand was inherited that land which can be considered as joint property
(2) Can I get 50% rights in the said property through partition suit in view of the above fact.
(3) I also want my share from the property. All my family members including my 5 sisters, father, uncle (except my brother) wants amicable partition of the family properties. My sisters have not shown any interest in the joint properties, but they also wants amicable partition between me and my brother. How to resolve the issue ?

Title suit

Respected experts,
I filed a Title suit against a person constantly claiming my land situated adjacent to him. We do not live there. In the w/s he disclosed that by the deed he is claiming belongs to my diseased father who is having three sons and four daughters, who too are necessary party, and the suit is bad for non -joinder of necessary parties and disclosed their names also. Now judgment passed in my favor, goes like this “Suit is and the same be decreed in favor of plaintiff against contesting defendants and against ex-parte decree against uncontested defendant.” No appeal has been filed, and 6 months has been passed Later we came to know the claiming had got this land in his family partition. Now my concern is that, can the ex-parte defendants (who are living adjacent to the land in suit and is having full knowledge of the suit) bring any fresh suit? Can a person join any suit suo- motto, if the property in question is related to him, and he is having the full knowledge about the suit? What is the limitation in recalling the ex-parte in this case? Thanks to all.
