Importance of property card for decessed owner

Respected Experts,

I am defendant/tenant. The plaintiff - owner of house has passed away.
To know the true heirs for the suite premises does the important proof of document should be property card? A relative of mines told me that property card is important and a must.

What if the plaintiff's son dont have property card, will he be still considered as legal heir?

Also plaintiff's son has informed the court of plaintiff's death but not submitted any proofs yet. 90 days have passed. Just informing is enough?

Thank you.

Fake signature

Respected Advocates,
A lady who is a retired employee filed a civil suit for declaration in March 2014 and written statement has not been filed by the defendants till now. A few days ago, the fact came to the knowledge of defendants UN-officially that on the date of filing of this suit, the concerned lady was out of India and her husband signed the plaint and vakalatnama writing the name of her wife in the absence of any power of attorney or any other authorization. Now, my question is whether before the filing of written statement, the defendants should file the application under order 3 rule 1 read with section 151 of CPC for appearance of plaintiff (lady) in the court personally and also for interrogatories and/or production of copy of passport of plaintiff. Please brief the line of action stating the relevant section/ order and rule.
Thanks

Sharing of expenses for leakage repair above my flat.

Dear experts,

Bathrooms and WC leakage is coming from top flat. The flat owner is arrogant and not repairing and some time not even allowing us to visit his flat ascertainment. One plumber gave estimate of Rs.20000/-. to be shared by both. He was telling this amount is being charged more. Blumber told to replace junk pipes in wall breaking some tiles and replacing them.

He called another plumber & now saying he wants to replace both bathrooms tiles & flooring fully including main repair jobs. He says for all this another plumber quoted Rs.60,000/-. He is now demanding 30000/- before. I told him I will share for repair work as per earlier plumber quoted Rs.20000/-. If you want to make new bathrooms you have to bear remaining. He dumped the telephone and not co-operating nor repairing his bathrooms nor allowing to enter into room. My queries are as follows:

1] Whether I am bound legally or as per bye-laws of society to pay for repair in bathrooms & WC to be repaired in his flat for leakage coming from his flat to my flat?

2) He is adamant and beyond understanding if does not repair despite sharing reasonable amount of 50%, what is next remedy, legally or otherwise immediately?

3) I showed the damage caused due to drifting of leakage water to ceiling, even in rcc pillar. The damage cannot be quantified but clothes and other material is damaged. Can I recover from him ?

4) Suppose huge expenses incurred, can they be demanded from Society for internal leakages since building's structure is going to be week due to such leakage, though internally? Society has also undertaken external repair work recently.

5} If complained to Society, society normally take stand that it is internal matter, both flat owners should settle it.

Your sincere and significant advise is solicited. Thanks.

Partition suit

Sir,

I am only one son for my parents and one elder sister in my family. My sister occupied the property in the year 1997 I filed Partition suit. The property was in my mother's name. My sister contested on forged Will subequently it was proved negative. My mother died in the meanwhile. The share were devolved in the ratio of 1/3rd share each myself, my father and my sister. Now the partition suit is posted for final decree and appointment of advocate commission. Recently my father died by executing will transferring his 1/3rd share to his daughter-in-law and dwelling house in the village. My sister with ill motive is claiming share in the house property and also 1/3rd share given by my father in the will. My sister is also claiming a share in the past transactions which are not existing today.

How can a married woman who got married in the year 1986 was given substantial dowry at the time of marriage still claim in the property which are not existing today except house and 1/3rd share in the partition suit.

Please kindly advise my is entitle for share when already in the partition suit she got 1/3rd share.

Thanking you,
