Dear Ld Friends!
I got a relative problem where he is insisting me to help him.
The Local Builder make a contract to the owner of the house to make multistory building having four floors with lift and fully furnished in one year, the builder will take one floor only for sell purpose and rest three floors are of owner and all this was written on 50Rs Stamp Paper and get notarized to it.
Now the builder pressurizing the owner to registry the one floor which he completed first for sell purpose and remained all the three other owner floors incomplete and refuse to make it complete all of three floors. Two years already over now since the house was given to the builder for making four floors.

Q3. Will I go for police complaint to take legal action against builder for pressuring the owner of the house to make registry of it ?
Q4. Will I seek remedy under suit of Specific Relief Ac for the performance of the agreement made between builder and owner on Stamp Rs 50 ?

I have paid fees in advance to a tuition centre for 10th std coaching for my son when he was studying in 9th Std as per the special offer in July 2006. Since I was not satisfied the way they conducted class for 9th, I have told them in Nov 2006 that if they do not improve I will have to cancel the admission for 10th (2007-08)and they have to refund the money. They promised improvement but it did not happen. Finally I have gave them a cancellation letter on 14th Mar 2007, well before they started the batch for 10th, and asked for refund. They have flatly refused refund saying that as per the policy fees once paid will not be refunded. I paid the amount (Rs.19000) by cheque and I have a receipt for that. No where in the receipt it mention that 'fee once paid will not be refunded'. I have followed up many times but they did not allow me to see the Principal even. Kindly advise how can I recover this money. Best regards/Jayadevan

Society started major repair like Re-plastering of external wall, Painting etc and they started raising additional fund which is being included in the regular maintenance bill without communicating to the member. is it right practise? Hence some member Paid full maintenance bill i.e. Maintenance + additional repair fund which is being included in the bill. But some of the member denied and paid maintenance amount only i.e. excluding repair fund. Now, after 6 months society has started charging Interest @ 21% P.a. How can society charge interest on additional repair fund since its not communicated to the member. Society work is still in progress. What is the procedure which society should require to follow before carrying out any major repair work in the bldg. Please advice on the same urgently.
In Mumbai BMC has increases property tax 3 times for the industrial property under the Capital Value systems, so the property tax is more than the basic rent of the property. under section 147 of MMC Act, landlord can received difference of property tax amount from the tenants/occupiers of the property. property tax is comes under permitted increases as per Maharashtra Rent Control Act 1999. Kindly clarify the same.
your action will be highly appreciated

Sir, my query is whether indemnity by a US Citizen will have any applicability in Indian courts? After demise of my Uncle (Indian Citizen-Died in N.Delhi) in year 2013, his two sons(born in India and US Citizens for the past 20 years ) are his only surviving family members. My Uncle had a SB A/C with a Bank at Delhi. How can they claim this amount from the Bank? In case of legal heirs being Indian citizen, Bank is ready to give to such heirs on an Indemnity by such heirs. However, Bank says that only Succession Certificate by an Indian Court will now decide who gets the money. Is the Bank correct? Whether Indemnity By US Citizen will not be binding on Bank in this case?
