1) After divorce/separation, the husband can move an application for the custody of a child under Guardian & wards Act AND if the parties are Hindu then under Hindu Minority & Guardianship Act ?
Query : So we can say that Guardian & wards Act are not apllicable to hindu but applicable to any other religion who are not hindus because for hindu Hindu Minority & Guardianship Act is applicable itn't it ?

dear brothers,
my client mohinder singh filed a suit against Tarsem Singh for specific performance of contract for directing the defendant to registered the sale deed and permanent injunction directing the defendant not to interfere in peaceful possession over the suit property as the possession of the property was already with plaintiff as per agreement to sell. that suit was decreed as compromise was effected. it was settled that Mohinder singh shall pay rupees 125000/- to tarsem singh in equal installments of 8000/- and last installment of Rs. 13000/- my client Mohinder singh paid entire payment in time against proper receipts. but during the period of instalments, tarsem singh sold half of property to jagjit singh who tried to interfere in peaceful possession of the property my client filed suit for p. injunction only restraining the defendant Jagjit singh to interfere peaceful possession of the property but the said suit has been dismissed + in appellate court. now appeal is pending in high court status quo order regarding possession is pased. my client also filed a execution against Tarsem singhfor registred the sale deed in that execution Tarsem singh filed objection that he has not issued any receipt the dh has not paid any installment hence he has sold the property. matter is pending for evidence of objector. sale deed has not been challanged so far. my question is my client is poor man he wants to get out from all litigations what should he do?

Hi,
I filed a succession certificate case for payment of deceased a/c from bank in the court of DJ.Before admission of this case I deposited court fee(app.32 thousand) as per state stamp duty in local SBI branch as per norms.After some time bank agree for payment without succession certificate and I received full payment.So,there is any provision to refund court fee.Please help me?

Sir,
We have purchased a flat 9 years ago. The building is 14 years old.
the builders has expired without dong the apartment deed.
In this case to whom does the terrace, Open Space and parking belong?
To the flat holders or builders heirs or to the owner of the land.
Does the builder have a right in his Will to give it to his sons?
Now the builders sons are not allowing the flat holders to use the terrace, in this case what should the flat holders do?

please member kinldy suggest me whether there is any procedure in civil law regarding the impounding of passport and stoppong the defendent from travelling abroad during the pendency of the suit. if it is there then what is the procedure for the saem and under which section it can be done.

can a false statement or misrepresentation be deemed as forgery for instance if a person states that he has such and such property but in actual he doesnot. can such misrepresentation be called forgery

Dear,
I live in a 2 floor house. Due to bad financial conditions my father-in-law sold the 2nd floor. the person to whom the floor was sold firstly took more than a year to give the money. and the moment they provided us with the whole payment they started fighting with us for some or other reasons as my father didnt allow him to make one more floor on the terrace. and the person didnt allow us to use the terrace. the lady (person's wife) has made false complaint on my husband that he tease her and passes on vulgar comments. for the safety of our house we had got CCTV cameras on our 1st floor and ground floor verandah. but they have the problem with it and they want to remove it as they cant do anything now.
my question is that the lady and her husband mentally harass us with one or other reason. can anyone tell me how should we get rid out of her as we have already made many complaints against them in police station but no use. police men ask for settlement but ww dont want to do it. we want the permanent solution to get rid out of them

How one should go in a partition suit (pending in a court), asking the court for cancellation of registered sale deed (s),without attracting the/payment of court fees.I know/and have proof of fraudulent transactions made by number of people.
