Writ filling by defendants

Dear Team,

The PW=2, had given GPA to PW=1, to represent before the civil proceedings.

During the evidence of pw=1, the advocate of pw-1, through his oversight did not mark the GPA given by the PW=2.

After the cross-examination was to the fag end the Defendant No-4 raised a point that whatever the PW-1 has given the oral evidence does not fit in the eyes of law.

Later the PW=1,new adovcate filed an application for recalling and marking of the document of GPA. The PW=1 had submitted almost nearly 21 documents with the GPA . But due to the oversight of the earlier advocate the GPA was not marked.

Now the application is allowed and the PW=1 , was recalled and got the Document marked.

But now the defendant is saying that they will file a writ against the order passed by the trial court.

hence, i request the team to let me know whether the defendant can file a writ against the order passed by the trial court. if yes then on what grounds he can take up the contention.

Thanks to the team who will reply to the query.

Easment

A and B has the dispute of the way. both are the owners of the plot, A statrted construction of the house so B who is the nighbour of the A raised the objection that where he is constructing the house is the common way as per the map of the society. In fact that was but in th new map tere is no way and therefore the owner has sold it out. A has purchased that plot by way of registered sell deed and the all the people who lives in the society have no objection if A complete the construction of the house only B has the problem because he want to purchase that plot for him and therefore he filed the suit for the injunction and cour has granted status Quo so that A can not construct a house. Now the question is that B niether using that way nor the people of the society and B have just purchased the said plot before 2-3 years ago so how he can enjoy the right of easment while he is not living there and people who are living there has no objection if A complete the construction of the house is thier any remedy for A.

Lawyer accountability

If the same lawyer is representing a client in 2 lawsuits, and makes contradictory statements in them with serious allegations, isn't the lawyer also accountable? Can any action be initiated?

Serving of summons on witness

I want to summon one of the defendants as witness by serving the summons via his advocate/counsel. I want to know if I need to pay any expenses to ask the defendant to appear as a witness. (Civil lawsuit in State of Maharashtra) Mine is an encroachment lawsuit in which the said defendant has encroached upon my land. He is living in the same city.
PS: It would help if anybody could provide the format for serving the process. Can I use the same format which is used when the court bailiff serves summons?
