After the death of parents brother filed civil suit (Permanent Injunction) on the basis of an affidavit signed by all legal heirs that they have no objection in giving him the property. The affidavit date shows of late almost 20 years back which shows the stamp attested from Oath Commissioner whose name and number is not mentioned on the affidavit. On the affidavit it reveals my name written in my own handwriting but not my signatures since prior to this issue of affidavit date my signatures as on passport and driving license and bank account are same as on date today also. Although the property is duly registered and mutation done in Tehsildar Office on all legal heirs since parents made no will. The civil court had also passed the Status Quo and advised not to sell or dispose off the property till final decision. Kindly advice me that how can I prove that on the affidavit it reveals my name in my handwriting and not my signature and when I had not signed any such affidavit of late 20 years back. Can any police complaint be filed in this matter or approach the higher court since there is also danger to my life since I had to attend court from far place due to my job purpose.

The Landlord is not accepting rent from all tenants for last 10 years. The building has been declared dilapidated by Mumbai municipal corpn.Landlord has been served notice by Municipal corpn to initiate repairs.Landlord has given notice to vacate to all tenants & has no intention to repair. Tenants approached Civil contractors to repair on their own by taking permissions but no contractor is risking repairs since building condition is bad. Tenants are living in danger to life being middle class people not having alternative. What legal recourse is available to tenants to force Landlord to reconstruct building or redevelop. The building is located near station & on prime residential area.Building is constructed year 1962 & tenants have paid Pagdi to landlord.Location Mumbai western suburb.
Sir/Mme,
I had filed a suit seeking declaration that one 'A', deceased 'B' & deceased 'C' are legal heirs of deceased 'X' & 'Y'. The court has declared only 'A' as legal heir and refused to declare 'B' & 'C' as legal heirs as they are dead on the ground that no relief can be granted for deceased persons. My query is that the relief was sought only by a person who was alive including the deceased persons. Is there any ruling/precedent to justify my relief?

Sir,
There was partition among childrens for fathers property in sunni hanafi family,
One son got 20 acres of land as per partition deed in 1976, but actual land was 24 acres whcih not known to parties at that time, and he sold his 20 acres along with unpartitioned land of 4 acres which was belonging to the father in 1996 to a builder, Can we file a civil partition/ possesion suit after almost 20 years against the builder and the son who sold the excess land which was not in his share. Any limitation as property alenated 20 years back.

in a case, summons have been ordered to be issued by the Hon. Court. However, it is apprehended that the Defendant will use all tricks to avoid receipt of those summons to delay the case. Please advise what is in the hands of Plaintiff in this situation to avoid such delay.
Stay on civil execution, cpc, tenant-landlord
Some landlord (and owner) filed a case of eviction against its tenant on the ground of personal neccesity which was decreed and eviction is ordered by the court. DJ confirms the rent court's order.
Tenant got a stay on execution from Allahabad HC.
Now I found out that the property in dispute is mine. My ancestors had purchased this property back in 1916. I found the original sale deed.
Landlord claims to be the owner of the same property by virtue of a registered sale deed of 1969 by some unknown person.
I am 100 percent sure that we never sold this property to anyone.
Once a stay is from HC is vacated and landlord is given possession i will have a long legal battle to fight.
Some suggest me to file an application under Order 1 rule 10. But, CAN A RENT COURT (Small cause) CAN DECIDE A TITLE?
Wouldnt limitaton be hurdle when i challenge the sale deed of 1964 ?
HOW CAN I OR THE TENANT GET A STAY ON THIS EXECUTION?
Please suggest a remedy that can delay or stay the execution procceeding for now and subsequently i get the property back.
Thanks & regards
Faiz
